To anyone who reads this - my appologies if I have put this in a wrong area I am not computer literate and it has taken a long time to get this far. I have been paying maintenance through the CSA for 6.5 years. I have fallen behing a couple of times ( i have always paid of the arrears) but all has been ok for some time. Over the years I have had a number of re assessments (that have never mentioned thsi debt) a number of account breakdowns (that have never mentioned the debt)and a lot of different schedules (that have never mentioned the debt). Out of teh blue last month I got a letter saying I owed 1200 pounds. I have spent all month on the phone and I have got to the point where they now sya that in 2003 I had a debt that someone "wrote of" but it has been resurrected - it is now they say 1050 pounds. They are demanding either full payment or they will go to my employer and take my contrinbuions to teh full 40 percent until is paid of. They sugested they I make an offer as it was their mistake I had worked out that I could afford another 23 pounds a month. They said no and that they wanted a minimum of 175 extra per month. Surely this can't be correct - what can I do. I know about asking for an SAR but cant see how this would help if their system is saying what it says. Please can someone help ? many thanks
Have they sent you any proof that this debt actually exists. If not, ask them for a Breakdown of how this arrears has arisen after 6 years of not receiving anything!
I wouldn't say to them your aren't going to pay it, but would like the chance to check to see if this is correct!
Hi - no they haven't told me why i owe it and they have said that I have to pay it. I said can I wait until they can show me how it arose and they said no. The system says I owe it and thats that. just spoke to solicitor and they have offered some advice but I think I am going to get sh...ed as the CSA seem like they are above the law in all respects
I am not sure this helps, but you can make an official complaint!
I have been in a similar situation with the CSA before, where the schedules they send you can be quite confusing! Mine is taken direct from my salary but the schedules they send my employers are the same as mine and my empolyers have been caught out before. The results of this confusion is arrears, which the CSA do not normally tell you about until the amount has reached quite a sizeable amount!!
If you are 100% sure you have been paying what you should have (You have had a number of reassessements over the years!), then make an official complaint!
