Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I recently entered a debt management plan with abacus. They then phoned me asking my permission to get all my loan details from the Halifax who I have 3 with. They have never sent them my loan agreements after a letter they sent giving them the usual 12+2 days so they had to phone them up to ask them for them and they have said they will send them?! What can they do if they still do not provide them by the end of this week (15-5-09) as promised? I cant recall ever being asked about PPI on the loans and I can guarentee that there is PPI on all of them- some of the loans would have been renewed of the last couple of years aswel!Any help would be great!!

Firstly if you have requested the information from halifax did you send a request under the Consumer Credit Agreement Act 1974?.
The relevant sections which are links to the act can be found in this link to the actual Consumer Credit Act 1974....

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc
Please do not PM me for advice as it may be sometime before I can respond.
Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
Thanks for the reply. Yeah Abacus sent the under the Consumer Credit Agreement Act, so what happens if they still do not supply any information?
I remember when I took out one of my loans last year I had a phone call from the Halifax asking if the guy who did the loan explained everything? I said no as the stuff they were talking about on the phone was not even mentioned when I took out the loan at the branch. I then got a phone call from the guy who sold me the loan in branch to go through it all again. I felt sorry for him and thought that I'd got him into trouble so just agreed with everything he'd said.
Thinking about it, it was pretty underhand stuff making me feel like I'd got him into trouble!!
