    Default barclaycard phone calls

    Hi

    I have two credit cards with barclaycard, although one is on behalf of littlewoods. I CCA'd both accounts and both just sent back the terms and conditionsicon, I then sent off an account in dispute letter and harrassment letter for both as I've been receiving non stop phone callsicon. Today I got a call from them telling me that they won't stop calling and their next action will be to send someone around to my house. Is this legal? How can I get them off my back?

    Hi Joolsie,

    If you start to discuss the 2 a/c's in detail, please use this thread for one card and start a new one for the second - or we'll get confused.

    Refuse to answer security questions and hang up on them - they'll get bored and the number of call will decline. Also, keep a log of the time and date of each call rec'd, even any which go silent on you.

    These people have no rights and will usually clear off quickly when they realise you're clued up and not about to be intimidated.

    Thanks, OK so this is where I am at with the barclaycard on behalf of littlewoods card. Sent CCA, they sent back terms and conditionsicon. I then received a default notice from mercers so I sent them a letter saying the account was in dispute and sent an account in dispute letter directly to barclaycard. Today I recieved a letter from mercers saying they are going to send someone around so I am going to send off the doorstep visit letter. Can I report them now because they passed the debt on when it was in dispute? And who do I report them to?

    re: phone callsicon. If you have an Iphone I use a bit of kit called MCleaner that will log and block 'black listed' numbers. 93 calls from Sharkleys since I sent my dispute letter, sometimes 8 in a day!!!

    Mercers are BC's in house collections department. I don't know who heads them up but they should be fired. Put the breaches down in a letter and send it to the CEO. The contact details are elsewhere on the site. The powers that be in Barclaysicon know about this problem. I just wonder when someone is going to sort it out. If I'm honest after reading this site I think this CCA action is just an aggrevation. I've never tried to claim the debt isn't mine, just need the interesticon frozen and a chance to pay it off. I consider I'm being reasonable and their harrassment of me is not. If you are using CCA to avoid paying a debt you have run up then I guess they'll consider you unreasonable and keep calling within the hours of 0800- 2000. Had I not been able to sort BC out then I would have gone down this route too as a matter of principle so I'm not criticising anyone for doing it mind you!

    Can anyone beat 5 calls in 8 minutes?????

    However, on Sunday evening (yep ,you read it right) I got a call from a UK call centre, very nice woman, in fairness, and I gave her all the phone callicon harrassment spiel from both barrels. She said, would I like her to remove my phone numbers from their record. And she did (so she says) but the calls have stopped, nothing since.

    Its early days yet but they do seem to have gone away.

    I did state that I wanted to resolve the matter but would only do so in writing, didn't lose my temper (an achievement, for me!) and was very reasonable.

    See how it goes!

    She also told me that BC only supply T&Cs in response to a s78(1) request as this was the advice given them by the fosicon. I challenged her to evidence the claim and they will write to me - I will start a new threadicon once I get a reply. I have also put this claim to the FOS directly.

    Anyone else been told this?

    Thanks for your replies, I'm not trying to avoid the debt, it's just my interesticon has doubled since I opened the account and I want to see the original agreement, I don't think thats unreasonable and I think their tactics are distgusting.

    Hi Joolsie,

    You'll not get sight of the agreement using a CCA with BC. If you read other threads here, you see they are mostly about this subject.

    You could complain to the fosicon about BC's tactics but specifically complain about their failure to produce the Agreement in response to your CCA request.

    Otherwise you may have to use the CPR strategy. See Link No2 in my signatureicon below.

    Hi Joolsie, I agree re interesticon rate hikes and tactics. Fortunately I've had a bit of a lull with these guys (and frankly they all seem to be as bad as each other) but my understanding is the debt - currently being managed with a dmpicon - will get sold on then the agro will start up all over again...if that does happen then I think I'll push CCA buttons with a vengence.

    People on other threads seem to be struggling with the CPR strategy now (although others have had success too). I'm not sure there is any sure fire way of getting sight of your agreement (or lack of) from BC.

    I posted earlier where a BC agent took my phone numbers off their system - I've had no calls from them since so it might be worth a try asking them to remove your details if you get a call from a UK call centre and the caller sounds half reasonable.

    It won't get your agreement but it might get them off your back.

    I can't try it now but would be interested in other people's efforts/ attempts.

    People were warned that it would take court once the two letters have been sent. I fail to see how the one applicant who went to court and got an agreement PLUS costs is counted as struggling.


    Anyway back to the OP, Have you thought about a fosicon complaint to get hold of the agreement? I believe another CAGGER has tried and got the agreement that way.

    Im going down the SARicon route to get a copy of my agreement.If they don't send it with my SARicon (Which they won't) then I will force compliance through the Court via an N1 form.

    As regards getting phonecalls stopped, well I was getting harassed at work/home by these people, so I sent them the Telephone Harassment letter, and also asked that they remove my phone numbers from their records.Seems to have done the trick....Touch wood :grin:
    I also sent the same letter to them through the 'how to complain' website

    I'm also struggling to get a copy of my agreement out of BC although I haven't tried the CPR route, yet.

    I have sent of my SAR but to date have received no reply - they are still within the 40 days

    First of all, this is my first post and may I say what a fantastic site. I stumbled across the site by chance and have personally experienced much of what existing Caggers have endured in the past. I too have had numerous calls from Barclaycard, Moorcroft, Mercers and others as my cards have mounting arrears and had it not been for this site would have had numerous sleepless night. I have quite a bit of debt on my cards but make a decent living and could pay my cards on time, however, these mercenaries have hiked up the rates to amounts that I cant afford so I decided to fight back. I am about to claim back my bank charges but have used a claims company to handle my credit card claims (they appear to be doing things correct) I am at the stage now where these companies are now in default as they havent returned the original agreements in the required time, however the phone callsicon have been relentless these past 2 weeks even stooping to the depths of telling my young kids that I must call these companies back immediately. Well, the war is underway. Many thanks to you all

    Hey, classic from BC. Letter from Albion (internal collection agency? can anyone confirm?) accepting "on review" 2 payments for July and August then demanding payment in full. All my other creditors have accepted the plan bar Eggicon (still waiting to hear) so what does this sort of letter achieve other than subtle threads (lot of RED and BIG text all over it). The plan is being maanged by a 3rd party. What a nonsence! Anyway, 3rd party sending them (again) a copy of the proposal reminding them that I can't pay any more. Oh well - keeps people in jobs I suppose! Now why doesn't that make me feel any better??!!
