If you stop the pay'ts, they'll start hounding you. Are they happy with the token pay'ts at the mo. If so, and the pay'ts are low, may be best to keep them up if you can.
If it's a real struggle, stop the pay'ts and send them the Account in Dispute letter (which they'll ignore or disagree with).
You can reclaim all penalty charges whether they have a Credit Agreement or not.
They won't send you the agreement in response to a CCA request.
