Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
12 months to the day I bought my wife a Kia Sedona from U Can Cars which is part of Carcraft, the following has happened what I can do.
When I was shown the car by the sales team, i noticed a few problems as in the dash had no lights and the gearshift was cracked, i was promised that the car was to receive a full 120 point check, a full MOT and any problems that came about would be put right. So on the basics of this I went ahead with the finance which is supplied by welcome finance limited.
Whilst the sales man was undertaking the paper work he also stated that a 3 year parts and labour warranty was available, as I work away I distinctly remember asking what is covered in this, and i was told everything.
On picking up the car I was given the keys and once again told any problems to get in touch and they would put things right. When I asked for the new MOT the female sales person ( by this time I had dealt with loads of sales people said that she had left it at the station, so i replied and said I would not leave until I had it in my hands, suddenly it appeared along with an advisory notice which i grabbed out of their hand as they was not happy in handing over, I noticed that it pointed out a problem with the power steering, but yet again I was told any problem call and they would deal with it,
I drove home and straight into an independent garage, who pointed out ever thing from different
From 3 different size tyres’ to no dash lights, to cut this part down this is what happened in brief
U can was contacted – refused to do any repairs.
Re contacted U Can but Cracraft took the phone call
Got manager who once I explained what was said to me over rid U can and ortherised the garage to complete the repairs, which came out at £1800 pound. As i work away i needed the car for my wife and 4 young children. todate
we took the care into its first MOT by us, to say the least it`s going to cost £2000 to get it thought this mot, things have major fails on them which should have been picked up last year, and the advisory notices is endless, on top off all this the mot people are asking how it past with different tires on. And the car had been dropped as the seals were smashed, believe me this is just an outline.
I re contacted carcraft who refused to undertake any of the cars problems as U can no longer trade even thought they dealt with it before they are saying that I have left it to long. I am a school teacher not a mechanic and this is the first mot I have had.
I contacted the finance company to ask what they will do as the interest on this car is major but you do what you do to solve problems, and they stated to me that they no longer supply them with credit as they were supplying wrecks there words not mine, and now the garage will not undertake any work from Cararft as they do not pay their bills.
And to top the cake, I contacted the warranty company to ask what I can clam and I was told that the warranty was named parts and only for two years, when i asked why i have never received any paper work they had a different address from the off i was totalled lied to and i still owe £9750 on this heap off??????
Its the finance co. car so it is in their interest and to put things right, also they are jointly liable for any major repairs that are not due to normal wear and tear while you have been using it. Go after the finance co and dealer jointly and take them to court if necessary.
Yep, just as ray says. Just confirm this is 'hire purchase' and not a loan?
