    Default abbey- bank charges can someone help

    i applied to re-claim my bank charges last july the charges total in excess of £1000. they have only once replied telling me the charges were lawful and that i would have to wait to hear what the test case outcome is , since then i moved all my DDs to my partners account, leaving my account empty to which they added a further 335 in charges sending the account overdrawn without an o/d facility. which i refused to pay they have since sent this to a DCAicon and closed my account.

    i have no idea how to chase up my bank charges claim , and if they have closed my account will this affect my claim? any help would be very much appreciated

    Having the account is closed will not affect your bank charges claim. Don't worry.

    You should write to the bank immediately and also to the DCAicon pointing out that the charges are in dispute, that you are claiming them all back and that they should not attempt to carry out any enforcement action against you.

    Have they or anything on your credit file? You should find this out.

    i have found my original claim letter dating 4th sept 09, and upon receiving further advice have sent th following.











    Dear Sir or Madam,


    Ref: Account number: xxxxxxx

    This letter is in reference to my earlier claim for £xxxx made on 4th September 08

    I have not received a satisfactory response to my earlier request for charges, which I believe, were unlawfully applied to my account.

    Under the Unfair Terms in Consumer Contracts Regulations 1999, charges must reflect administration costs and cannot be punitive.

    The £ charges are unlawful, as they do not reflect the true cost of going into an unauthorised overdrafticon. As a result, I intend to claim the full amount plus interest and court fees through the county courticon.

    I look forward to a full response to this letter within seven working days, otherwise I will commence court proceedings.

    IS IT RIGHT THAT WHILST IAM CHASING THEM FOR MY CHARGES THAT THEY ARE NOT ALLOWED TO CHASE ME FOR ANY MONIES AS THE ACCOUNT IS EFFECTIVELY IN DISPUTE???

    have had a letter back saying until the test case goes through they have all complaints on hold
