Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I posted this on the business banking section but had no reply so am hoping for a bit more luck here! thanks for your help.
I had a letter from Sharkley card commercial today saying if I do not pay the overdue amount (which I cannot afford and they know that) they will issue a formal and final demand.
Can I send off a CCA request letter? Or does this not apply to commercial accounts. I've done a search on the forums and cannot find anything relating to B/C commercial.
I don't profess to be an expert here, but if the account is in your personal name then a CCA request is fine. If the account is in the limited company name then CCA proberbly does not apply.
Are there any penalty charges on the a/c over the last 6 years - these can be reclaimed quite easliy.
The discussion about whose name the a/c is in is probably not necessary. BC would ignore any CCA request anyway.
If you are looking to question whether the credit agreement is enforceable, you may do better using the CPR strategy - see Link No2 in my signature below.
