Received ticket in private car park with no "clear" warning
Guys
Hope someone can give me good advice on what to do as I feel really annoyed after just receiving a 150 pound car parking ticket today. I actually went to a private car wash and parked at the side with my 5 year old son. We were actually going to go to the car wash but thought we'd pop to the shops across the roads for 10 minutes to look at something first.
When we came back we had the ticket which says if you pay within 48 hours they reduce it to 100 pounds. It's from whites car park solutions ltd. The thing is there was a sign near the exit of the car park which we did go near when we went to the shop but myself or my son were simply talking to each and didn't see it. It wasn't exactly that clear TBH i.e. wasn't in big letters "WARNING" or "NO PARKING" , it was a sign with quite small letters, black writing on white background.
Should I simply not pay on these grounds that it wasn't that obvious. Although when I look at the sign the guy there pointed out it obviously did look obvious. If it was perhaps 25 / 30 pounds I wouldn't have so much of an issue paying but 150 or even 100 seems absolutely **** loads for just taking 10 minutes of time to go shopping and we even had intentions to use their car wash, but certainly won't give them any more money for this service now
Help appreciated as being a single parent dad I really can't afford to just hand over 150 for nothing.
Re: Received ticket in private car park with no "clear" warning
Ignore it.
You will receive a few letters. You may also then receive letters from a DCA.
Ignore all of them.
It is not a fine. It is an invoice, which is unenforcible. The PPC cannot identify who was driving the vehicle. They may identify the registered keeper who is the one that any letters will be addressed to but the registered keeper is not necessarily the owner and is not necessarily the driver.
If you scan the ticket and post it on this thread (minus all identifying details, etc.) we can confirm it for you.
Likewise, if you do receive any letters, don't respond to them.
Have a good read of the threads on this forum and you will see.
If your username is your real name, then I suggest that you change it for a username that cannot identify you. The enemy is known to read these forums and there is no point in giving them any help.
If you want to change your username, send me, or any other Site Team Member, a PM stating what name you want to use, and we can change it for you.

Hi Rooster,
Thanks for your response. You mentioned the PPC can't identify who was driving the vehicle however what if they had CCTV which caught be driving the car off e.t.c. ?
I've attached two scanned images showing both sides of the car parking ticket. Should I simply not acknowledge the letter at all then as it mentions enforcable by court if I don't respond within 21days?
Re: Received ticket in private car park with no "clear" warning
The images are a bit small but I can see that it is a "parking charge NOTICE" and therefore it is unenforcible.
I have a CCTV camera on the front of my house. I shows anyone who passes or visits my house.
It shows the faces of visitors, OK, but it doesn't tell me who the visitors are........ It doesn't know their names.

Thanks Rooster,
So if I get a number of threatening letters and from the DCA I assume I don't need to be concerned that they could in any way effect my credit rating or have baliffs coming round to take 1000s of pounds worth of belongings around after incurring any stupid charges they like to put on top ?

Re: Received ticket in private car park with no "clear" warning
Ignore all correspondence from them. They are a mickey mouse outfit and have as much legal right to ask you for that amount of money as I have. Cctv makes no difference whatsoever, its the person that parked it, not the one who drove it off that they need to identify. Listen to Rooster, hes been doing this for years. jed
Re: Received ticket in private car park with no "clear" warning
Sorry guys to go on, but also couldn't there be a problem because I went into the office their to ask what this was for and there were 3 guys working there one of whom put the ticket on. I was asking why I had the ticket and where were the signs e.t.c. Couldn't one of them come to court to testify that I was actually there disputing it and getting in the car.
Re: Received ticket in private car park with no "clear" warning
Stop panicking Matt, they are going nowhere near a court. Dont contact them, dont go into their office, dont talk to them, dont, dont, dont do anything. They will go away after a few letters, stop worrying.

Yes in the unlikely event of them going to court they could identify you as the driver, but this is not how you would defend their claim.
The amount they are charging is not a fair estimate of their losses (i.e zero), but a punative penalty charge which any judge would thow out of court.Plenty of other threads that explain this.
Like most law abiding motorists you are obviously worried about this, but find some nerves of steel from somewhere, ignore all correspondence, posting it on this thread as and when you get them so we can all pull them to pieces and give you on-going advice.
Keep everyone updated, follow the advice given here, and it is an absolute certainty that in 3 to 4 months they will have given up, and you will wonder w hat all the fuss was about.
