    Question New member- advice please on my agreements.

    Dear All,

    I hope someone can help. I'm sure all the information is within various forums but as per a suggestion in one of them, it's probably worth starting a brand new thread to consolidate all my replies.

    The situation is as follows:

    I have 2 credit cards and a loan with Eggicon.
    Both cards are maxed out. No payments have been missed for either of the cards or the loan until last month.

    Egg have told me that they are serving a default notice against me and that I have 28 days to pay the arrrears amount on one card.

    I have also missed the April payment for the other credit card but as yet no default notice has been served against me - it will be though by next week.

    I have made 2 payments of £1 each for both cards to show committment to pay and haven't totally ignored the due payments.

    I was made redundanticon in Feb this year and have put my loan on a payment break for 3 months. I'm due to pay the next amount on my loan at this end of this month.


    I was mis-sold PPIicon on the loan. If I was to use it, it would kick in in August of this year (180 days after losing my job) so i have to pay the loan back in May, June and July.

    The loan was for an amount of £18000 and the PPI totalled £4250. I now have approx £8995 left to pay.

    The credit cards are no longer being used.

    My questions are as follows:

    1. Should I claim back the PPI?
    2. If I claim back PPI can I pursue unenforceable agreements options?
    3. Should I go down the Unenforceable agreement route? I've already sent off for the agreements from Egg but have some of them already - i'm waiting for their versions though before I make my next move.

    4. Based on the agreements, do they look like they're unenforceable?
    5. If I don't pay the due payments for the credit cards, I go into default and therefore they cancel the agreement. I can then no longer go through the unenforceable agreement route (can I?), so since timing may be an issue here and they may not respond in time, should I just make the 2 payments due, in full and then try the unenforceable route?
