hi there i was just looking for some advice in regards to an issue a friend is having and they dont have the internet so im doing this for them ...
they have been customers with buy as you view for about 4 yrs roughly and have never really missed a payment they are paying about 120 pounds every 8 weeks for the goods they have ie; tv, lcd tv, bed, dryer,nintendo ds , at this moment in time she is struggling to make a payment which is due as her income has been dramatically been cut to bearly nothing , and shes struggling at the moment , buy as u view are due round for a payment any day now , she is considering returning the goods but i have noticed on a previous thread ( brighthouse thread) that if u return the goods she might get some money back as she has nothing of theres , or ...
considering she had paid for 4 yrs on the goods shes got, has she got any right to keep any of the items at all, shes worried that the amount of money she has paid she might end up with nothing at all , and would have wasted nearly 2 yrs of payments , and gained nothing , as the title says BUY AS YOU VIEW , so has she actually bought anything in the 2 yrs because everytime shes had something they redo the contracts and payment options , so she cant tell what shes actually payed for
any help would be appreciated shes panicing at the moment ,
I'm pretty sure this is the same as any other HP scheme. As long as she has paid more than 2/3rds of the agreement then they need a court order to take the goods. Even if she has not paid this much, they can still not take the goods back by force.
If she gives the goods back voluntarily, then she will have no claim on any money paid. The only way you can get money back is if they take the goods (that have more than 2/3rds paid off) without a court order. Then you can claim back all the money paid.
I don't know how bayv treat their customers, but has she spoken to them about her situation?
I would seriously take a good look at those agreements to. If she has had some items for 4 years, she must surely have finished paying for them. She needs to request copies of all her agreements (unless she has them already) to check this one out.

ty i will find out the info and keep you updated she was under the assumption that because she got another item every so often that when they keep redoing the agreements it just kept putting her back to the start of the agreement ... basically back to scratch even after 4 yrs ...
Well, thats not the way it should work. Even if they re-write the agreements, all previous payments made towards each item should be included and none of her rights should have been lost. They cannot make her repay the full value of the goods all over again. That's why the agreement needs checking carefully. If possible, scan and post what she has (covering personal details) - that will help enormously.

right heres an update to the situation she spoke to buy as you view this morning and asked if she had actually payed off any of the items that she had , even the original tv that shes had for over 3 and a half yrs , and they said NO because they said that everytime u get something else they readjust the finance so it kinda starts again so after all this time she has not payed off any items at all even with all them payments , CAN SHE send the items back and demand a refund or some sort of refund as for paying for all this time and still not owning any of the items shes being paying for over this period of time .

Something does not sound right here. By re-writing the agreements they are taking away any rights she would have (i.e. after 2/3rds paid off they need court order to remove goods etc). I will have too ask someone else to take a look at this, because bayv is not one of my strong points.

bayv have always worked like that. Every time you get a new item they re-adjust the finance. I am a former customer and i will help as much as i can.
BAYV made my life hell. I moved house in 2007 and told BAYV in writing several times. I told them on the phone too. After moving i kept asking them to send someone out to collect payments. They promised to send someone but never did. Finally in August 2007 a rep came round. He was threatening and abusive to me in front of my child and told me he wanted the full amount (£2000) or he would have me arrested for 'Absconding'. He reposessed my tumble dryer (I told him to take it cos it made squeaking noises). He could not fit the dryer in his car so he left it on the street outside my house where it was taken away by the rag and bone man. He said i was going to be put in prison.
I wrote to BAYV after calling Citizen's Advice and they promised to investigate but never did. I was arrested in September 2007 by the police after the BAYV rep had told them i had committed theft! I was put in a filthy cell then interviewed with a solicitor present. BAYV had said i owed them for the TV (Bought in 2000, paid over £1500 by then), a vacuum cleaner (which was paid off), the tumble dryer (which he had already taken) and a Hi-Fi (which i had returned to them within a month due to defects). The police put me on bail and after almost 6 months of trying to get BAYV to provide the 'evidence' the rep had told the police would be provided. I have heard nothing back from the police since.
I then sent many letters to BAYV asking them for statements among other things. I got 1 reply so i ended up reporting them to the Financial Ombudsman Service. In the end the fos managed to contact BAYV who wrote the entire debt off.
I hate them and they deserve everything they get. If you want any help i will do my best.
AS A CUSTOMER OF buy as you view I MUST SAY I HAVE NO CONFIDENCE IN THEM AT ALL . I HAD A LETTER FROM HEAD OFFICE SAYING THE COLLECTOR WOULD CALL ON THE 22/06/09 EMPTY THE METER .WANTED 97.00 POUND HE TOOK 53.00 OUT OF METER AND SAID HE NEEDED A FUTHER 99.00 POUND .COULDNT PAY SO I WAS HARRASED EVERY DAY OVER A PERIOD OF 4 DAYS .THEN THEY SENT A 6FT PLUS GUY WHO REALLY LOOKED THREATNING AND DEMANDED THIS MONEY I GAVE HIM A CHEQUE WAS NOT HAPPY . NO UNDERSTANDING BAD CUSTOMER SERVICES NOT INTRESTED IN CUSTOMER COMPLAINTS AT ALL. THIS LOT ARE THE SAME AS BRIGHTHOUSE DIFFRENT NAME .I WAS DISGUSTED WITH THEM INDEED .SO KEEP YOUR EYES OPEN AND ANY ONE HAD A BAD DEAL FROM BUY AS YOU VIEW LET US KNOW YOUR EXPERIENCE GOOD OR BAD
yes anybody wanting to go with bayv i would take a wide berth from them we took out a tv with them which was covered by insurance. anyway the tv was pulled off by are young son which we wanted to claim accidental damage which was clearly covered by insurance they came and took tv away to have it repaired left a replacement tv for kind measure but when we inquired about when are tv will be back to us they told us that it wouldn't and that the insurance was void due to missed payment??? bad as that sounds the missed payment was because they wouldn't come to are house to collect after being asked on numerous occasions.
area manager turned up one day before xmas demanding the loan tv back that they had installed whilst are one was being fixed under the insurance.
we explained what happened but he wasn't interested in nothing and would not even admit it was there fault we told him he would not be getting the loan tv back until are tv was delivered back here which he refused so told him again not getting tv back he then said he would ring the police so my partner invited him to use are house phone which he declined and said he would do it back at the office.
he left and we have not heard nothing from bayv or the police and that was nearly 7months ago.
so for all you guys reading this that are thinking of going with bayv then think again they will harass you and send people to be intimidating but stand your ground and always remember if you have paid that third towards the goods dont just let them take them remind them that they must get a court order to do so else you will be entitled to claim back all monies paid under the agreement.
good luck to all of you and may the hate against bayv continue they are scumbag company which are now in competition with are local brighthouse so lets hope they go down the pan shortly
ps: on another note if you happen to come across another company like them called family vision then i would also think about taking any goods out with them as they are just as bad or not worst than bayv
buy as you view are pure scum, go to the fos i have had problems with them for the last 6 month i am ready to take them to court over maintance and warranty sending my final letter the morn then its off to money claim online nothing to loose..,.
I have been a happy customer of buy as you view for over 8 years and with the exeption of one small misunderstanding, i have had no problems. If you keep up regular payments things can and do go smoothly..
I have had times when there has been not enough money in the meter, we have explained our situation to the rep or manager and they sorted it out without any fuss or "agression"...
Do not judge on a few mishaps. They can and help when they can if they can. With any credit agreement if you fail to keep your your end of the deal there will be consequences it doesn't matter where you get the goods from. I was one of the manager's of a large popular elecrical retail store and i was responsible for credit agreements. If any parties default on any part of the agreement the store or retailer can reposes the goods with a writen court order.
In short if you cannot offord to pay hundreds for your goods buy as you view can help just make sure you can keep up the repayments, know your limits and dont go over them.....

I'm really pleased to hear how happy you are with bayv. You're absolutely right, if you fail to keep to your comittments on a credit agreement there will, ultimately be consequences... Of course, most reputable companies keep within OFT guidelines, and will often be more than happy to help with genuine cases of hardship...
Clearly your time as a manager was with one of the rent-to-own retailers (BrightHouse, BAYV, Perfect Home etc) because only goods purchased via a HIRE PURCHASE agreement can be repossessed. Electrical retailers such a Comet, Curry's, PC World etc only provide credit agreements whereupon the purchaser instantly OWNS the goods, and can only ever be liable for the debt if problems occur...

Ok guys - how many more times have you got to be told about this bunch of rip off merchants? They are shortly going to feature on RIP OFF BRITAIN programme because that is exactly what they are RIP OFF MERCHANTS! I know because I work for them (got to pay the mortgage some how Im afraid). If you want to send your goods back it is simple - just dont pay and they will take them back! Dont worry abourt court and all their idle threats - they dont take anybody to court because they dont want to expose the way they operate! If you inclined to do so (and hundreds do every month) just dont pay and they will stop calling after 28 weeks they will just write the account off!! THEY CAHRGE OVER THE ODDS FOR THE PRODUCTS THEY SELL, THEY CHARGE OVER THE ODDS FOR THE interest THEY CHARGE, THEY SCREW CUSTOMERS WITH INSURANCE AND WARRANTIES AND THEN THEY SCREW CUSTOMERS SOME MORE WHEN THEY SELL WITH ROLL OVER FINANCE!!!! In the North East there is a [problem] called Buy As You Bump which is costing these scum a fortune!! Im not saying it is right or that people should do it but the fact is there are people out there who know how this lot work and are playing the system. Why dont bayv do anything about it after harrassing and failing to get cash? Like I said they dont want to expose how they operate!! Just for your info this company are owned by Barclays!!!! The CEO is a fat bloke called Graham Clark who used to work for Brighthouse!! BAYV/BRIGHTHOUSE/BANKERS - heaven for the fly fraternity - a big pile of ****!
