I had a Credit Card with Coop bank and I wrote in March asking for a copy of the agreement but did not include a £1 postal order - I didn't know about this till I discovered this website.
They replied saying they have ordered a copy of the agreement. This letter was dated 1st April and as of today I have not yet received it (maybe it was just an April Fool!). The day after - 2nd April they issued a default notice, I've just discovered that that is illegal after reading stuff on here.
Anyway my question is this - they haven't provided the agreement within the 30 days but as I didn't send the £1 initially should I write another letter using the template with the £1 and take it from there or can I proceed onto the next stage as they have replied to my letter?
Firstly the statutory time limits is 40 days for an S.A.R request and 14days for a CCA request.
IMO I would send off another request enclosing the £1 fee i say this because if you took to the next step they could then say well we did not receive the fee.
So its best to be one step ahead of them all the time plus you do not want to waste good paper and ink.
one more important point do you have the default notice in your procession if you do can i suggest you post it on here removing personal data so this can be checked for validity.
Most DN from the co-op are invalid due to the dates of remedy.
Scan it if you can (photo if not, but that is never as good). Then you need to open an account on somethiong like photobucket, upload the image(s) and post a link here
