    Default can anyone help

    My son bought a digital box costing £89 After a few months it broke and comet gave him a new one. Again after a while this has broke same thing again. Comet said that they couldn't do anything as it was out of guarantee. The Second box was only6months old. Comet said that the guarantee runs on from the first box that was purchased and not from when he was given the new one. Is This correct? Any advice would be helpful.

    I believe that is normally the case.
    A similar situation arose some years ago, with "TUF" shoes. Can't remember what the guarantee period was but postmen and other traders that basically walk for a living were wearing them out within a few months and taking them back for replacement. Then the replacements would be worn out within a few months and so they were replaced again, and so on.
    On that basis, they only ever needed to buy one pair of shoes..... for life!

    this has nothing to do with guarantees, this is merely a question of the application of the Sale of Goods Act.

    The goods which you buy have to be of satisfactory quality. This means that they have to work and remain working for a reasonable period of time. To my mind this would generally mean that least five years or so -- but depending on the kind of item we're talking about.

    Something like a digital set-top box which is no working parts, is never moved around, and simply sits there, receiving and decoding television signals should last much longer than one year. The shop guarantee iis just a con which is intended to lull people into forgetting what are their statutory rights. Very often poorly trained shop staff are also lulled into the same kind of forgetfulness.

    I would suggest that you insist on a repair or refund and threatened with court action if they do not agree quickly and if they do not do it quickly.

    Take the unit back with an explanatory letter and tell them that if they do not sorted out within seven days and you will Sue them.

    You can't lose and you get your court fee back and it will be a useful and empowering experience for you.
