have made a claim against Lloydsicon TSB for about £3000
The basis of my claim was:
I felt pressured into taking out the insurance (no insurance, no credit card)
Also told them it was responsibility of salesman to find out my personal circumstances and whether I needed it or it.
I told them I have been in the same job for 25 years (Liverpool Education) which offers a good illness/redundancyicon package.
I have savings and endowment policies plus equity in my home.
My wife also has all of the above.
If salesman had asked the correct question hw would have realised I did not need PPIicon insurance
I was also never advised I could take out a policy with another company if I wanted to.

The reply I received was:

LLOYDS TSB as a matter of practise does not make the purchase of insurance compulsory in order to receive a credit card.Your application for a credit card would not have been compromised by the absence of cover
We took steps to ensure the customer was fully aware of the optional nature of the cover
They then quote that between 2001-2005 they sought to comply with GISC for private customers
Key points:
Ensure information is clear fair and not misleading
Provide customers with enough info to make there own decision
Provide policy docs and costs
Ensure any advice given meets customers needs

The PPI cover was sold before FSA insurance conduct of business started to appy on 14/1/2005
Until then it was not a specific requirement to discuss existing insurance arrangements.
The prevailing process covering LLOYDS TSB at the time PPI was sold,REQUIRED OUR ADVISERS TO PROBE CUSTOMERS FINANCIAL CIRCUMSTANCES,ASCERTAININ G HOW THEY WOULD COPR FINANCIALLY IN THE EVENT OF ACCIDENT/SICKNESS/UNEMPLOYMENT/DEATH TO COVER THEIR COMMITMENTS.
If you had received benefits from other sources such as employer,income protection etc it would not have affected your ability to make a claim under this policy.
I also believe it is reasonable to assume that had you held any such benefits then you would have raised this with us at the time.

So they are saying their salesman should have asked all the relevant questions, but he did not.!!!!!!
They never do with past experience from other cards.

I want to take this one to court.
Which arguements from the various court bundles (any links) could I use to argue this one. ?

Have any of the banks actually turned up in court ?

I took LLOYDS TSB to court over the bank charges and they never turned up for that one and paid out in full

Any comments would be most appreciated
