Barclays Business Account Overdraft - CCA or SAR Request???
Hi People, been reading the forums regarding overdraft's, not sure what to do! Basically I opened a business account with Barclays (sole trader) in 2004/5 and at the time didn't want an overdraft, business was good untill last year around june/july time things were bad and I could see cheques/direct debits bouncing if business did not pick up fast so I applied for a overdraft of £2000 online and was declined via email! so about a month or so after cheques started to bounce and barclays where taking their £35 charges, and they paid a few direct debits when there was no money in the account! all this (direct debits and bank charges) caused the bank account to go in the red of £2100! in august the business folded and barclays closed the account aswell put a defult on credit file, and started demanding payment of the overdraft! I agreed to pay it off in £100 installments a month but last month I got a new card issued from Halifax and they didnt have the new card details to take the payment from so now I've got a letter from them demaning the £1700 remaining! also threatning to sell the debt on, what can be done in this situation? as I applied for the overdraft but it was declined and then they paid! do I send a S.A.R Request or CCA Request?
Re: Barclays Business Account Overdraft - CCA or SAR Request???
Hi Xibrax,
A CCA request is inappropriate for your overdrawn business a/c.
An SAR is only required if you don't have the bank statements to show what charges you've suffered. As yours is a business account, I assume you keep all your state's.
You can try and seek repayment of your a/c charges but it is not straightforward as you'll see reading cases in the Business Claims forum.
I'll move your thread to the Bus's Claims forum now.
