I requested my CCA from Virgin Feb 09 by way of 77-79 of the CC Act.
In March 09 I was sent a copy of my current T & Cs & most up-to-date copy of my card statement but not a copy of my original CCA. The letter stated that "copy of original credit agreement has been requested for you and should we be able to provide you with a copy we will forward it to you".
I then heard nothing so have begun CPR requests and I did a SAR.
SAR arrived this morning with a 5 page printed credit card agreement with electronic signatures for me on page 4 and for them on page 5 see below:
Does this mean my application would have been an online application in May 2006?
Does anyone know when Virgin started online apps with electronic signatures?
However, if it was online then surely they could have just provided it back in March 09? It just seems they could just knock this 5 page copy up?
I called Virgin and they couldnt tell me whether the original application was paperbased or online.
Is the credit agreement in the form they have provided enforceable ? If it is I am suspicious as to why they didnt provide it straight away since it would have been held electronically ?
Anyone with experience here I would be grateful for some advice !
They sent me the same paperwork for an online appl done in 2005, I think online signatures came into effect that year.
I can only assume what they sent is their interpretation of True Copy because it looks nothing like the online screen I went through at original application stage. At least Egg send the screendumps this effort could be knocked up by anyone.
I have noticed that only apr is shown on the agreement, this is contrary to schedule and should be rate of interest on any credit in the agreement.
Also did they comply with the cancellation notices info.
