The other consideration in all this is that BC have effectively been refusing to produce credit agreements recently, thereby denying the consumer the right to see if there is an enforceable agreement.
SMT has used the CPR strategy laid out by Pt2537 to force BC to produce the agreement.
If they CAN produce it, and I'm sure they'll try looking hard this time, then it can be checked for enforceability.
If they CAN'T produce it, injuction time and GAME OVER for BC on this a/c.

Are BC refusing to produce any and all credit agreements, or is it just agreements that were previously: Morgan Stanley/Goldfish agreements?

I can fully understand why BC are reluctant to provide pre 2001 MS/Goldfish agreements.
However, if the reluctance relates to other and general BC agreements, I would have thought that the answer is fairly obvious;
the alleged debts are in Limbo.

If that is the case, then I would be asking for notarised proof that the account(s) have not been securitised.
Notarised: A document stamped and signed by a Notary Public.
I would also request that said document be countersigned by their Company Secretary.

Hi,
I started to look at securitisation for Barclaycard a couple of weeks ago, but got very muddled. They use two securitisation companies, Gracechurch No.-something or other, and I think the other one was Cumbernauld something. These companies appear to be affiliated to bcard, so I wasn't certain how that worked . Then I went on to check if they held licences and some of them said 'historical' which I didn't understand.
That is as far as I got. Maybe someone who understands this stuff rather better than I do could have a look.

Not quite sure why you created a thread for me re: Barclacard, a I am not at odds with them. Apart fron the fact that they continue to unlawfully process my data re: a Morgan Stanley account that was settled some time ago.
My only intention in posting up on the previous thread was to assist others concerned on that particular thread.
I moved your post and all the replies to avoid further hijack of smt's thread. Many are following it and need to see how the case progresses, which is difficult with all the subbing and congrats making hte thread so much longer.
