Hi folks, just wondering if anyone has experience with Egg re threats of issue of a default notice.
We are 3 months missed payments with these donkeys, account is in dispute months ago with the Ombudsman surrounding PPI mis-selling.Yet, true to form, egg are threatening DN to recover the arrears.
Now, will the DN register on our credit file - if we clear arrears in full within the DN timescale?
Any experience with their threats would be appreciated.
If they actually issue a DN (rather then just threateneing to do so) whilst the account is clearly in dispute (in your case with teh fos) then they will have contravened OFT guidelines on debt collection and should be in trouble with the FOS.
What I would do in the first instance is to write to them saying that the account is in dispute as it is in the hands of the FOS. If you have a FOS case number, quote it. Tell them that, should they choose to contravene OFT guidelines and issue a DN whilst the account is in dispute, you will inform the FOS immediately. Tell them you are sending a copy of the letter to the FOS (which you should actually do).

THe DN gives 14 days to pay the arrears. If they are paid in that tie, nothing should go on your credit file

You mean the oft leaflet ones they are supposed to send after 2 missed payments?
Then No......
no the ones that came in 2006 regs notifying you of arrears, think you are supposed to get two before they send default notice, I know you are going to pay arrears but wondered if Egg generally comply with the reg.
