    Default Soon 2 be Ex husbands debts

    My husband and I agreed to seperate in July, but were living under the same roof. It was apparent that he was struggling to pay his credit cards despite not contributing to the household expenses. Two weeks before Christmas I returned home from visiting family to find that he had left taking his clothes, personal belongings and momentos of our son.

    He has not told his credit card/loan companies of his new address, and has defaulted on all the payments. I have told the companies over the phone that he has left, I have no address for him, and no telephone number.

    The letter kept coming and I have returned them. I have now started to open his mail as there are letters from solicitors stating that legal proceedings were to begin with bailiffsicon etc. I sent letters to these companies by recorded delivery to state that he does not live at the house anymore, but is this enough?

    I have my own financial problems and am in a debt managementicon plan with the CCCS. I cannot cope mentally with dealing with his....

    Any advice would be welcome.

    I suggest that you start opening is mail and simply mark it "no longer at this address" and then put it back in the postbox.

    It is probably a good idea to write to each company is well and to point out that he moved out on such and such a date, that you are now separated and you have no idea where he is. Then he points out anyway that you would have no obligation to inform anybody of his whereabouts now.

    Especially make sure that you inform bailiffsicon and also the court. if you have any communication from any court then be scrupulous to return that to the court with a letter saying that he is no longer that address and you don't know where he is.

    It would be better to send this letter is by recorded delivery and keep copies and records of postal receipts etc so that if you get trouble later on you will be up to show people that you did let them know.

    If you find that you are still being hassled by company who you have already informed then you should complain to the trading standards as these people are behaving unfairly.

    You might also write to the credit reference agencies and asked them to put an entry on your file that your husband is no longer at your address. I'm not sure whether they will agree to do this that anyway send them a letter, keep a copy so that you can demonstrate later on that they were put on notice and if they decided to ignore your advice then it will help you to be able to show that they were informed.
