Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I just received a parking fine this morning from Civil Enforcements Ltd. Apparently I outstayed the allocated 2 hours allowed for the facilities of the car park. The car park is the only one for Pizza Hut. Although there is a KFC and a DVD hire store on the land they do have separate car parks. On the day in question I went to Pizza Hut with around 15 others friends for dinner at around 16.30pm and left around 18.45. I did not notice any signs, nor did any of our group. Considering there were a lot of us and no-one noticed any signs I am unsure how visible they were.
I did not receive a ticket on my car at the time so was completely unaware of this until today. All of my friends who were parked there at the same time have also recieved these notices.
I just find it disgusting that I chose to eat in Pizza Hut and spend money in their restaurant to be thanked with a PCN for £75, which will increase If it isn't paid in 7 days. With such a large group it was bound to take longer and as it was the waitresses first day it took much longer than it should have anyway and the desert hadn't even arrived by the 2 hours allocated. However, this is beside the point- aren't we entitled to enjoy our food in leisure without worrying about being fined for it?
Having since visited Pizza Hut and spoken to the manager, apparently he does warn all large groups about the fine (it was his day off when we went) and there were notices on the door to warn of trouble they were experiencing with parking issues.
I am a student, as are all my friends and cannot afford this hefty fine. I do accept when I have done something wrong, but I feel intimidated and worried by this and would appreciate some advice on how to tackle it. The others in my party have already contested their fines so I act on my own behalf.
There is no point in "contesting" or "appealing" against the invoice as it will be rejected. (They always are) If your friends who have appealed dont know this yet, they are about to find out.
Do not write to them
Do not telephone them
Do not reply to any letters Do not pay them
Tell all your friends to do the same
I would then put all the invoices in an envelope and take the whole lot into pizza hut and tell them they can do what they like with them, but none of them are getting paid. Of course, you should also point out to them how many customers they have just lost through the action of their PPC!
Based on my own experiences with these cowboys & their sidekick newlyn, my strong advice to you & your friends is to totally ignore the junk that will pour through your letterboxes over the coming weeks & months. They will attempt to intimidate you & weaken your resolve.
Although they are cowboys, they are in fact all hat & no cattle.
Don't bother contacting them in any way & DON'T PAY THEM.
For added reassurance, please take the time to read the many threads & posts on these [problem]mers, & advise your friends to do the same.
They do not & never will carry out their empty threats.
Thanks for the advice.
I haven't done anything yet other than to read some of the messages on this forum. I do feel that I should write an initial letter to them aginst paying the costs, I am worried that if ignore them and they catch up with me I will end up paying a fortune.
Sending ANY letter to them only makes sure you go on the top of their Christmas card list, and easter list, and birthday list, and any other list they can think to use to write to you!
No contact with them whatsoever is by far the best recommendation.
As lamma says, resist the temptation. Unlike on Star Trek, resistance is not futile when it comes to PPCs
