Hello I'm new to the forums and as there doesn't seem to be an introductory one this seems as good a place as any!
It makes me sick that banks and credit card companies and the like (who after all are the guilty ones creating debt illegally out of nothing) are harrassing decent hard working people. I've read a few of the posts on here and will be adding some comments shortly.
I really started to feel depressed last summer - the first time in my life I realised what that meant and having thoughts of self-harm. Fortunately I have managed to resist and it's my kids that keep me going. I'm a single mum and it's so hard having no one to turn to, my parents do help me out occasionally but they don't know about the debts.
I got into trouble when I started my own business a few years ago and did not get enough funding from the bank due to a combination of bad advice from business link, my accountant and Barclays bank. I stupidly started using my credit cards to fund the business and took out a couple of loans and re-mortgaged my house (up until this point I had an impeccable credit rating with my cards paid off in full every month and a very small mortage which is now nearly double what it was before.) Also I had to switch to an interest only mortgage last year so am currently not paying anything off the capital. About a year ago I went to Lloyds TSB where I had had a personal account for years and asked them to refund a few charges and to consolidate my loans because I could see what was ahead. They refused and I ended up having to default on the loans which I was trying to avoid, the charges mounted up because they were making me go over my overdraft limit each month and in the summer I ended up abandoning the account and moving my income into another account that I hadn't used for a few years. I have had a few of the charges refunded but after discovering this wonderful forum a few days I have ordered the small claims book and am going to start legal action to recover them. I still have a claim outstanding against Barclays for charges on my old business account so thanks to the information on here I can hopefully get that amended and get those back too. Luckily I managed to get a new business account with NatWest due to a colleague of mine knowing the area manager so I finally had a decent overdraft facility and have managed to keep that account within the limit. Just goes to show what a farce it is both Barclays and the Coop bank had refused an overdraft but get to the right person...........
I got a claim yesterday from the county court from CL Finance about a card with GE money and it was so relieving on here to read that others have had the same problems with them and have won. I am going to use the templates on here to get the CCAs from my other credit card companies and get those all written off too. I just found the template to send off to the debt collectors to stop the harrassing phone calls, it is affecting my kids because they get annoyed when I don't answer the phone. I know the times they ring now - so predictable! I have another company dealing with the loans so hopefully they will be written off in the next couple of weeks.
Added to that I have been having problems with the council, my benefit claim due to me being self-employed and not having much of a regular income. God what a load of incompetents they are, every one tells you something different and they still haven't sorted out the latest claim since last summer. I am now in the process of using common law to prove that it is unlawful anyway, will let you know how I get on with that. Council Tax | Facebook
Well that feels better for sharing - well done if you've read this far! My business is definitely suffering because I am not as efficient as I should be and I have suppliers chasing me because a gitty charity that conned me last year and issued a CCJ (to my old address they knew I'd moved) without my knowledge so am now in the process of getting that set aside so I can refinance and reduce my loan and overdraft payments.
I do try and focus on the positive because after all you only attract more of what you focus on but it's bloody hard! This website is bloody wonderful and as soon as I am back on track I shall definitely be making a huuuuuuuuuge donation (secret millionaire here I come!).

i cannot say i understand totally the huge stress you must be under, i do agree that somehow we do manage to get out of something sometimes and this site has been a saviour to me this past year
i did see no one had answered you and i wanted to show my appreciation of your courage in telling your story so far,,,, keep positive and i wish you all the success in the world with your business,
you are right we must no longer keep thinking of the bad things in life and try and get positive thoughts so that good things start happening

I know exactly how you feel, I feel so ashamed of my debts and the effect it has on my family, but Im starting to dig myself out of a big hole, thanks to the generous people on here, giving up their time for others..
Thanks Angel and Tawny, got a letter from another DCA today - I rang them straightaway, gave them short shrift and said I did not have a contract with them and would be returning their letter and if they attempted to contact me again I would report them to the Data Protection Agency.
I also got around to writing to Traffic Enforcement Centre (what a joke!) in regard to a parking ticket I have been disputing since last July thanks to the info on this website and TPUC I think it was rather good even though I say so myself!

Get your letters off asap, send them RD or SP so you have proof. digital signature or Initials, Print, Type and if you have to sign in your usual manner put lines or crosses through so that nobody can digital enhance your signature. Make sure you keep a copy of your letters as well and post anything you need help with.
Your CC that you received if you can copy it up thro photobucket or scan it making sure your personal details are covered up you will get even more help.
Keep your chin up and please try not to worry I know its hard but everyone will help you. Lets see all the muppets off.

Thanks diamond, I am so fed up with these idiots taking me away from what I need to be doing. It's disgusting that they are still allowed to get away with it but thank goodness awareness is growing.
I purchased my Sprint phone on Monday, 05 May 2008. I should have received the rebate by Monday, 11 August 2008. I repeatedly submitted the rebate request and each time Sprint claimed the requested was never received. After submitting the rebate request numerous times via mail, fax, and email each and every time with Sprint continuing to claim the rebate request was never received I began filing rebate fraud complaints against Sprint in March 2009 and I still have not received a rebate check. Sprint has lied to me and the Better Business Bureau about this matter. This company has no intentions of sending the rebate check and that is fraud! As of Friday, 29 May 2009 I have filed a rebate fraud complaint with the following 55 agencies/sites/blogs and will not stop until I receive my rebate check and three months free service for this blatant fraudulent behavior. When this is over, Sprint will wish they never heard of me and I will be a prepaid cellular user.

While I sympathize with your phone problem, as you appear from your post to live in America, there is probably not much that we can advise you on.
This is a UK site and although we are able to help users in dealing with UK law, etc., we are not familiar with the law and consumer issues in America.
I would suggest that you look for a similar site, based in USA who would be in a better position to help you.

I found this site when I googled Fed Up customers. So far I have received nothing but a warm reception and I am very thankful. My intentions are honest and true. Sprint is a global company and I believe that if they are going to very extreme lengths to defraud customers in one country then they (Sprint) will go to extreme lengths to defraud customers in other countries that they operate. My post is to inform and educate consumers. I believe we all work very hard for our money and should not be lied to, disrespected, or defrauded by any business we chose to patronize. I believe this to be true no matter what country you reside. My post was not a request for help (although if I receive help I will not refuse the offer, I am always very appreciative) but to inform, educate, and give encouragement to anyone wanting to battle a company. We as consumers have very powerful purchasing dollars and have the strength and right to stand up to a company that has defrauded, lied, and disrespected anyone of us.
The power of the internet is that I can bring my story to so many people and give them encouragement if they find themselves in similar situations. I have posted in other countries and the response has been very positive. Others want to know what is going on worldwide. Although they might not be able to help they have been very kind and encouraging. Once again, my intentions are honest and true.
