    Default Dell laptop what are my rights

    Hi,
    I purchased a Dell XPS M1730 in November 11th last year through my my business and recently its had problems.
    I phoned them, then emailed them on the 14th of this month went through some emails back and forth with some solutions but then the laptop completely stopped working and wouldn't even power up so they arranged an engineer to come out on the 22nd to replace the motherboard.

    22nd engineer turned up replaced motherboard but laptop still not working for which the engineer phoned Dell who said the new motherboard must be faulty and he said Dell will ring me.
    waited 2 days then I contacted Dell who informed me the case had been closed some more appoligies and arranged another engineer visit for the 28th.

    28th engineer turned up replaced motherboard again and exactly same problem nothing, so engineer phones dell and again they say must be another faulty motherboard.

    I had to phone Dell as they didnt bother ringing me but ive now refused to have the laptop reapired and want a refund or the whole unit replaced with exactly specification unit as the unit is less than 6 month old.

    could some one please give me some advice on my rights for this case

    From your account of what has happened I think that you are in your rights to say that they have now repudiated the entire contract and that you accept the repudiation and that you want your refund. Alternatively that at your discretion you are entitled to have a replacement unit.

    Gather together all your evidence. Make a very careful chronological note of everything that has happened -- visits, conversations both on telephone and face-to-face, and collect all your correspondence.

    Send them a seven days letter before actionicon. Outlining exactly position and the reason for it and tell them that if you do not have your money back or a new unit within seven days then you will issue proceedings against them in the county courticon without any further notice.

    At the end of seven days, begin your action.

    I would say that your case is unloseable and that you will get your claim fee back as well as your reasonable cost of travel.

    Don't take any nonsense or excuses. Stick your deadlines. carry out your threats.

    If you only want to bluff them then don't bother to do any of this.
