    Default I replied to a PCN from a Private Company.

    Hi I'm new to this forum and wondered if I could just get a few pointers. I've read the stickies but just wanted to get a slightly clearer view for my circumstances.

    I was issued with a pcnicon by AS Securi-T for parking in a vistors bay without a permit at my friend's flat. I have attached a scan of the PCN at the bottom.

    I did actually have the permit but it feel out of sight. I gather now I was a bit silly in bothering to telephone them and then send them the following letter.

    Dear Sir or Madam,

    Ticket number: XXXXX
    Vehicle registration number: XXXXXXX

    You issued me with a parking ticket on XXXXXXX but I believe it was unfairly issued and I will not be paying your demand for payment.

    I have parked at XXXXXX on many occasions and have never previously been issued with a ticket as I have always displayed a permit. On this occasion I also displayed a permit, it was slipped into my tax disc holder. Unfortunately it appears the tax disc holder came away from the windscreen and the permit dropped into the foot well. I am sure the warden’s photograph of my dashboard will corroborate this and I am therefore requesting that the fine be waived.

    Please find attached a copy of the valid permit I used that night as further proof of my claim.

    I then received what appears to be a very generic reply (attached) denying my appeal, although I never said I was even appealing rather I wasn't paying.

    I gather I should have just ignored them and a lot of people seem to be advising ignoring them now. Is that the best approach or should I send them one more letter refuting their claim again?
    Also the warden just put a scribble next to "was seen by........(attendant)" is that sufficient?

    Any help would be greatly appreciated thanks. As a student I could do with not forking out £100+ fine or ending up in court

    I would just ignore them in the future when they invariably send a series of apparently more threatening letters.

    Private parking ticketicon = penalty = unenforceable in law = no payment.

    In the unlikely event that you receive a sealed court claim form then do not ignore that, let us know.

    What a monkey in a high vis jacket writes or doesn't write on his unenforceable invoices is neither here nor there.

    • do not pay
    • do not contact them again
    • ignore the threats they send you
    • they will give up and go away

    I'm not sure what happened with the documents. Hopefully that's a better copy of the ticket.

    And the letter said;
    ----------------------------------------------------------------------
    I thank you for your letter.

    1) The parking chargeicon Notice xxxxx was issued for failing to comply with the rules and regulations governing the parking on the Private Property, known as xxxxx

    2) There are warning signs all around the site, which clearly state the rules and regulations and consequences if they are breached.

    3) AS Securi-T does have a signed contract from the Landowners & their agent appointing the company to monitor the site. The Data Protection Act does not allow me to release this information, however, I will produce this information in court.

    4) The pcnicon was issued due to the fact there was no permit on display, a PCN will be issued to any vehicle not displaying a valid permit.

    Your appeal is unsuccessful, consequently, you are requested to send your cheque..... blah blah blah.

    Right, so they have admitted quite freely that they have a contract with the landowner, and that you have breached that contract. They have now absolutely stuffed themselves because no judge in their right mind would accept £150 as a reasonable restitutionicon for any breach, let alone one where you had relevant authority in the form of a permit to park, therefore could not even be considered to be trespassing.

    Let's hope that they have the opportunity to produce the contract in court, because they will be setting themselves up to be crucified if they tried to.

    Best advice now is just ignore everything else from them except genuine court stamped papers.

    MBNA - Agreed to refund £970 in full without conditions. Cheque received Sat 5th Aug.
    Lloyds - Settled for an undisclosed sum.

    more than just stuffed. their contract is 'to monitor the site' so any purported contract is with the landowner not the PPC. Privity.

    and complete and utter rubbish about the Data Protection Act.

    As usual PPCs don't 'understand' of follow the law - if they did they would all be out of business where many feel they belong.

    Let us hope they issue real court papers for this - and turn up !
