    Default Brighthouse - Help!

    Heya guys.

I signed up with Brighthouse a couple of months ago (stupid, I know) I am a week late with my payments now and I am unable to carry on paying the weekly amount I have been, due to circumstances.

Since signing up my home phone number has changed so they are unable to harass me with phone callsicon BUT...I have just spoken to my mum and she has told me they have been calling her telling her to tell me to get in touch with them (no nastiness or threats....yet!) I put her down on my application as a reference, are they actually allowed to do this!?

I was planning on using one of the templates on this site to write to ask that all comunication be written only, if I do this will that stop them being able to call my mum or any other references I gave?

    Thanks for any help!

Hi and welcome to the forums,

I take it you have only changed your phone number and not your address?

If you leave it any longer without paying then the will be knocking on your door, I promise you that.

If you send the letter asking for communication in writing only, then you may also include your immediate family in that letter. But being as you are the only named person on the credit agreement, I am not sure if this will have the desired affect. Your mother may have to write personally to BH to halt these phonecalls.

No-one can chase a relative for your debt, as they are not responsible for it, you are.

But all this is really besides the point. You say that you have only had this agreement for a short space of time. You are only so far a week late. So far then you have not really paid that much for the item. The very nature of a hire purchase agreement is that all payments are considered a rental until the last payment which buys the item.

So, you have only paid so far for what you have used. If you are in that much trouble that you can no longer afford this item, I would advise you cut your losses, return the item and have done with.

And if you can avoid using BH in the future, call it a lesson learnt.

Are you being harrassed by a DCA or Brighthouse. Click the link for OFT Debt collection guidelines. Chances are, they could be in breach of some part of sections 2 or 3 or both!

I just give advice, I can't do it for you though!!

If you were helped, then please wiggle my scales, and you might get a wiggle back!!!

    Thanks for the reply.

I figured someone would say something like that lol and I do agree. But I REALLY cannot go without one of the items I have, not even for a couple of days, so I am kinda stuck!

From reading other posts I guess there is no point calling them to try and arrange smaller payments until I am back on my feet? Does my account HAVE to be up to date before they will remove the optional service cover?

I have seen that many people have said they cant reposess the goods without a court order if you have paid a certain amount, what if one hasn't paid that amount, can they enter my property and take the items?!

They cannot just walk into your property and take back the goods, so dont let them tell you that they can, however they are still entitled to collect the goods as you have only just started your agreements. I would suggest that you put your intentions in writing to them as plumberjohn has said or they will come knocking. The optional service cover is exactly what it says, OPTIONAL, so i would get it removed this instance.
