    Default Problem ordering goods from Website in the EU

    Firstly please forgive me if this is the wrong place. Moderators, please move this thread if it is!

    I recently attempted to order three items from a website in Germany, a fellow EU country. The website has a catalogue in English and a script based order form, again in English, to order their products online. They advertise that they sell inside and outside the EU. Prices are in Euros.

    I placed the order as instructed and elected to pay by paypalicon (which was an option) on receipt of their confirmation email, which would include the total catalogue prices for the three items and the P&P cost for UPS delivery to the UK.

    I received an email within an hour simply instructing me to contact a dealer of theirs in the UK. The prices advertised on their dealer’s website are considerably higher than the prices advertised on the company’s website in Germany.

    I am quite upset that they choose to accept orders on the main website only to pass you on to a dealer in your own country, who in this case charge a lot more.

    My question is, under European law, can the company in Germany do this and refuse to take my order placed despite providing a catalogue/price list in English and an online form for placing orders? Can I force them to honour the order or at least their price in Euros?

    Does it specificaly say on their website that they ship to the UK?

    Hi, thanks for your reply.

    The company do not state individual countries to which they ship. My understanding from their website is they ship worldwide. They have a different payment procedure when shipping within the EU, in comparison to countries outside it however, they do have the following statement on the order page.

    "If you are situated in a country within the EU where there exists an exclusive national distributor for Baader Planetarium products, we will gladly transmit your order to this local distributor to assure that you receive the product in the fastest way and with the lowest transportation costs. In this case we will notify you."

    The problem is that the agent’s prices are not the same. This seems to be creating a situation where the same product is vastly more expensive in different countries within the EU, due to the monopoly the manufacturer may have created by forcing consumers to order from one supplier in their home country. The prices on the company's website are clearly shown but these prices do not equate to the ones being asked by the agent with "exclusive national distributor" status.

    Can I do anyting about this?
