Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have already had a claim settled as a result of court action against the Abbey in Nov 2007. After winning this case I have been concentrating my efforts on my battle with my health, however although my health is still not exactly brilliant, I feel well enough to begin my second round against Abbey.
This is for charges incurred after the period I have already settled. There are a couple of things that I hope the more knowledgeable of you on here may be able to shed some light on for me.
My original claim included the charges Abbey had levied on me but not the overdraft interest they charged me whilst being overdrawn, can I now claim this back and if I can should I do it with this new claim for additional charges or do it as a seperate claim?
I am now off to calculate the amount of rip off charges and statutory interest they owe me now, plus of course the overdraft interest for this second lot!
Here's hoping for a quick payout, on hardship grounds due to being on state benefits.
Don't hold your breath cos they are proving to me to be totally inconsiderate to the plight of claims under financial hardship. They promised to investigate my claim/complaint in 8 weeks max but it's now been 9 and could last another 2/3!! It took 3 weeks to send me an income/expenditure form (after chasing them twice for it!!) then after reciving the info they sat on it for a further 2 weeks again doing nothing (yes they admitted that!!) So my advice to you would be to make a real nuisance of yourself and maybe just maybe they'll actually do something.
