    Default Employment rights for 'Self-employed' period?

    If someone is asked to work a few weeks of probationary period on a self-employed status (ie, not paid by payroll but on invoice), and then subsequently becomes a standard payroll employee and doing the same work, does that initial (self-employed) period count as the begninning of work for purposes of holidayicon pay and pension entitlement?

    Or can the employer contend that the employee only became an employee once she was put on the regular payroll but not before then?

    Employment status is always difficult to give a definitive answer about. The only certainty is that ET's have repeatedly stated that employment status will be decided on a case by case basis, depending on the specific facts of each case.

    Ultimately, if you and your company cannot reach agreement on this issue, then your only option would be a complaint to an ET within 3 months of the denial of the right.

    If you like the job, it would be wise to consider if this is really worth it, considering the relatively short period in dispute.
