Hi Guys, can anyone advise what I do next, I sent the original letter to them on 26th March 2009 asking to reclaim my PPI as ever since taking the loan out I have been a self employed IT Contractor and not eligible to claim for unemployment. So far I have not even received an acknowledgement and I want to know what would be the next step for me to do.

They have 40 days plus 2 for postage to respond to you supplying all the data they hold on you.
You should expect the following:
A true copy of the original Consumer Credit Agreement together with the terms and conditions applicable to that agreement with all the prescribed terms.
Copies of your statements up to date.
Copies of all correspondence they have sent or received by either letter, email, fax etc.
All other data they hold in what every media/format ie paper, electronic, CD, floppy disk, microfische, taped records or transcripts of tapes, notes made during telephone conversations etc.
Also be specific and ask for the needs and wants/customer duty of care questionnaire that they should have completed at the point of sale to ensure they had asked all relevant questions to ensure the PPI product was suitable for you.
In the meantime if you get no response within 8 weeks to your letter of 26 March or they give you a final response saying no refund you can you straight to the fos with a complaint. This will take months but you should know FOS are upholding 90% of complaints it also will cost HSBC £500 for the FOS investigation.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
Finally had a response from HSBC and they turned down my request to reclaim my PPI. Although I was self employed at the time they said I would still be able to claim PPI if I wound up the company and signed on. Bearing in mind I am an IT Contractor with normal contracts of about 3 months at a time, this meant that every time I was in between contracts, I would have to wind up my company and then when a new contract cam along (could be 1 week, 6 weeks, 3 months), i would have to reset up my company and start again and continue this practice in order to be eligible to claim the PPI. They also basically said that I had a guide to PPI when they sold me the policy and it was my fault that I did not read it properly and cancel it at the time if I wasn't happen. Correct me if I am wrong but isn't the onus on them to give me correct financial advice.

Submit a complaint to the Financial Ombudsman Service. Give them the full story with copies of all correspondence between you and HSBC and let them decide. It will take months but the fos are upholding 90% of complaints. Here is the linik for contacts....
If you submit a complaint it will cost HSBC £500 and if the complaint is not upheld you still have the option of Court action.

Unbelievable, After 2 and a half years and out of the blue, had a letter from HSBC saying they had reviewed my claim and decided to uphold it with a redress of £4500 (which is more than I was expecting). Have accepted the offer has money will come in very handy !!! Does anybody have any idea on how long it takes for HSBC to put the redress back into my HSBC account??
