Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have just put my claim into court who will serve the papers to Natwest,so now I will just wait to see what Natwest does as they tell me that they dont agree with the OFT
Chris, I think we'll be dealt with together at Cobetts. I don't know you well enough yet to share the same filing tray for a week or two! I put the request in last night to the Court, and it has been issued today.
Does anybody know on which day service will be deemed to have taken place. I think it's five days, but does that include today (Friday), and does service take place on the fifth day, ie Tuesday. Any ideas? It would be so tidy if I could count the 14/28 days from Tuesday, 1st August
I'll put further posts on my own thread, VT v Natwest Bank, so as not to hijack yours.
the court told me that I will receive papers from them letting me know when the bank was served with the papers, and that if I didn't hear from the bank within 14 days there would be a part on the bottom of my papers to fill in for judgement to be served, as yet I havent heard from the court or the bank, hoping for some thing in todays post
Chris, I think you are one day behind me. This morning (Friday) I received a copy of Natwest's Acknowledgement of Service from the Court. They say they intend to defend all of the claim.
Interestingly I haven't heard anything from Cobbett's. The form is signed by a rogers at RBS co uk who signs as the defendant's solicitor. Does this mean they are doing their own litigation now?
Is everybody else being dealt with by Cobbett's or has the work now been taken back in-house. After all, Cobbett's didn't seem to be having much success!
Cobetts were very successful for Cobetts! They must have made a fortune out of RBS!!
Can't believe how negligent they are being at Natwest and all of the banks in paying out so much money to solicitors and in court costs as well as all the 8% interest that they wouldn't have to if they just paid the money back when you asked for it! Their shareholders are being let down so badly!
Anyway, its great for us I suppose. I hope mine gets that far too so that I can claim my 8% on top of the charges. That alone should pay for a nice little holiday!
Good luck with it all, can't wait until mine gets to that stage, its so frustrating waiting!
with luck I should hear something soon then, I am willing to go to court if I have to, I think that they hope we wont dare go that far then they get to keep OUR money
the papers were deemed to be served on the 7th so Natwest have until the 21st, so I hope the postie will be here with a nice letter for me soon, I am so pleased for you Michelle, it must be a load off your mind, you can go and have a brill holiday now
oh well, I am counting the days now, the postie just been, but nothing yet, am I toooo impatient, I think I will start and do my bruvs credit card for him, take my mind off the waiting game
Don't think it'll get to the stage of judgement being passed at this point. They're tending to file a defence on the last day .. sometimes a day late, but the courts are accepting the defence anyway. Probably a bit more to'ing and fro'ing yet matey! Sorry to be the bearer of slightly bad news

still have not had any word at all from Natwest, so I suppose that they are waiting till the last minute to file defence, why do they keep doing this, it seems a pointless action, they are just wasting time and money
