Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Do people think it is even worth trying to persue the following with the potential of damaging my credit rating?
I am well aware of charges on accounts and keep what I thought were tight reins on my account, however I made a small mistake when I had to pay for some holiday money (It was a spur of the moment thing), and I have had the first letter telling me I have been hit with a paid transaction charge of £25. I am also likely to get another £25 charge for going over my overdraft limit for two days.
I am keen to persue these charges and A&L offered me 50% back over the phone (from the paid transaction charge - Other charge has not been added to my account yet) which I am not too happy about, however I am worried about the account closure, parachuting my account and it affecting my credit score as I like to hop mortgages every couple of years (Will this be effected?)
I have never waivered other than this since owning a bank account (probably 12 years - although not always with A&L) and I am really annoyed with the bank and myself.
I will be closing the account soon anyway as I am going to move to another provider.
Claiming your charges does not have a negative effect on your credit rating. Why should it? You are only claiming what is rightfully yours. If you are planning on closing your account anyway I don't see that you have any problems.
It is up to you if you are willing to let them keep any of your money or if you feel that you should have it as a matter of principle.
When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

I was under the impression that when A&L close the account down you get a mark on your credit rating and this is the reason you open a parachute account as it may be difficult to get an account after A&L have done this? Apparently A&L are doing this quite a bit in retaliation. This is quoted from the FAQ on this website:
Q. Will suing my bank affect my credit report?
A. No - unless the Bank closes your account - see below.
---
Q. Will the bank close my account?
A. It doesn't happen often but you should bear it in mind - see below
---
Q. Are there any other risks?
A. There have been instances where the banks have closed or threatened to close accounts by way of retaliation. There is always a risk involved in taking someone to court. If you are in any doubt of your claim, you should contact a qualified professional.
---
Q. Can I stop them closing my account?
A. Although there are some legal arguments against this kind of retaliation, it would be very difficult at the moment. You would normally only be able to try and take action about it after the account closure. We are in the process of testing the legalities of account closures, especially with the Alliance & Leicester.

This could be 1 reason, but the main reason is time. The time it takes to apply for and set up a parachute a/c and the time taken to rearrange DDs, SOs, transferring wages etc. If you wait until they actually close your account, you could be in banking limbo for some time
I see your point, but have not heard of marks being put on. I will try and clarify this. However if you close the account yourself then you will prevent A&L taking retaliatory action and closing it for you.
If you are seriously worried about it just wait until you close the account yourself, as planned, and then claim it.

You can claim after closing the account. I would normally suggest accepting the half payment and informing them that you will pursue the balance, but you may prefer not to do that while your account is open. I really think you are worrying unnecessarily about your credit report though. You could accept it now, but you would not be tied to any Full and final settlement proviso they might suggest as the rest of the amount is still unlawful, so you could not be tied to it.
