    Default LLoyds /Moorcroft chasing debt with no records

    I had an overdrafticon a number of years ago with Lloyds which I had been paying blindly for over ten years which was made up of charges interest etc. then challanged the debt with Sechari Clark and Mitchell who had taken over the account, and with some help from this site was able to get them to admit they could not comply with the CCA request or SARicon request as no documentation for the alledged debt exsisted, this was quite a few months ago and since then I have not heard from them, then today I recieved a letter on LLoyds TSB Headed paper but with Moorcrofts address, I rang the number using 141 to keep my number private and it was answered by Moorcroft, are they allowed to use LLoyds headed paper to try and confuse consumers, also I need to send them a good response to stop them putting any more default notices on my credit account, the letter they have sent clearly states the following.
    Loan provided - unavailable
    loan amount - unavailable
    interest rate - 0%
    Term of agreement - unavailable
    this is the duration if the agreement as provided in the agreement and dose not take into account anything that could vary the term, for example if you take a payment holidayicon or make an overpaymenticon
    Creditor - LLoyds TSB Bank
    opening Ballance £3,961.00
    Closing Ballance £3,961.00

    this is a strange one but The original overdraft was only for £2,000 then after ten years when they were supposed to stop any further charges it has almost doubled any help or suggestions would be welcomed

    I got exactly the same letter/form but from Credit security Ltd in Whitechurch.
    In my case I took LTSB to court (in the good old days before cases were stayed) and won the case.

    I rang Credit security who said that Lloydsicon had taken the case back.
    Lloyds are telling me a number of stories
    1. Its a requirement of consumer credit act to send this annually
    2 Its a [problem] and nothing to do with them
    3 They have no information the papers are still with the solicitors
    4 They have absolutely no sensible explanation to offer

    Sechi Clarke and Mitchell are I believe owned by Lloyds but not the collection agency whose address was on my letter

    This seems very odd I wonder what remedy we have after all I owe nothing and they appear to have issued this to a debt collectoricon

    any body got any ideas

    I am sure I have seen somewhere on one of the threads that it contrveans all collection guidelines for them to pretend to be another company by using any letterhead but thier own, I wonder if Lloydsicon know they are using this tactic to try and panic people, and for them to openly admit they have no details whatsoever but still try to collect money is just ludicrous they have a duty to check all required documents and information is available before they can even contact people.
    Hope someone will jump in here soon to offer a bit of advice on where to go next i dont want these clowns regestering details with the credit refrence agency as that will take an age to get removed.

    another letter from Moorcroft today offering 50% discount on the account what do we have to do to get rid of these people

    hello, Moorcroft don't have any duty to check that all documents are available, they take on accounts in good faith and it is up to Lloydsicon to provide the documents.

    If Moorcroft are unable to satisfy your request for a copy of the opening agreement, they legally have no choice but to return the account to Lloyds as they legally can not collect on the balance. You need to put your request in writing to Lloyds as Moorcroft are incapable of getting anything right, and if Lloyds are unable to provide you with the documents you request, then you need to contact their regulatory bodies as they should not be collecting this balance without proof you owe anything else.
    Until they can prove you owe this balance the account should remain in dispute and therefore can not by law continue collection activity while an account remains in dispute. I would not contact Moorcroft by anything other than in writing as in my experience, they only note down selected information and usually leave out the vital information you inform them.
