    Angry should i be entitled to full sick pay

    I have been with my company for ten years. I have currently been diagnosed withneck and back propblems that i have got through my type of work i do. Recently whilst working i slapped in the upper back by a fellow worker which has caused me to be on sick for the past month. my company does not pay sick pay unless its a work related illness, and therefore declining to give me any pay they have also contacted me saying that i owe them money due to overpaymenticon. Should i be able to claim for full sick pay as i belive it is a work releated injury.

    Hi, sorry to hear about the back.

    You seem to be referring to a contractual sick pay scheme, and therefore the answer lies in the contract.

    You need to read the wording of the contractual sick pay scheme carefully to see if you should qualify.

    Post the wording here if unsure.

    You should also consider if you have grounds for an Employer's Liability claim as the accident happenend at work.

    If someone has hit you hard enough to cause you to be off sick I would be informing the police (if deliberate) and raising a grievanceicon at work.
