Parking beyond double yellow lines no restriction signage
Hi,
I received a pcn for parking beyond double yellow lines off the roadside in a layby. There is no restriction signage at all on the stretch of road. The PCN was issued for "parking in a restricted street during restricted hours".
Could someone advise as to whether I should challenge the PCN and if possible a suggested form of words.

If the lay by had lines through it, then the restrictions match those of the adjacent roadway. The plate providing the times would have been nearby, but not within the confines of the lay by itself. (The term 'lay by' here is a bit of a misnomer - it's probably an inshot or other device).

A DYL doesn't require a sign as it means 24hr no parking. I think what may be in doubt here is whether the "lay-by" is a legal definition of where you were parked, or is it just a pull off off the road that everyone treats as a lay-by?

There was a modification to the traffic signage rules - I can dig it out if anyone wan't the actual document reference, that stated Councils could dispense with much of the individual signage, if they erected a 'master' sign at the entrance to the controlled parking area, to advise all passing it that regulations existed.
In the last year or two Glasgow City Council has erected some (yellow) information signs that state "Absence of yellow lines or signage does NOT mean there are no parking restrictions. This is a Controlled Parking Area"
To my way of thinking, this is just another way to allow cost savings by having perimeter signage and nothing else.

Cost saving and revenue raising no doubt. How many people have time to read a sign safely whilst driving past it then parking 3 roads later? Not to mention the fact that even if you noticed the sign (which you probably didn't be cause you weren't thinking about parking yet), would you have made a note to memorise it on the off chance that that sign would also apply to the road you end up parking in which you haven't even selected yet?
