    Default Cancelled Tax

    Hi,

    Hope this is in the correct section


    Basically girlfriend purchased a cheap car from a 2nd hand car dealer and it was advertised as being sold with Tax and MOT.

    She has owned the car for a week now and today has received a letter from the Post office / DVLA stating that the cheque used to pay for the Tax (by the car dealer) has been returned unpaid so the Tax disc is now void.

    We have just looked at the car dealers website and the car is still on there and it stated as having Tax and MOT, so these have now been printed off as proof.


    What is the best way to approach this, is this time criticle ie. do we need to be looking at some kind of court action ASAP?.

    Any advice would be appreciated

    You could try a personal visit to thr dealer asking for the money it saves court costs.

    First off is to get the disc by paying for it yourself, you could let yourself in for problems or even lose the car without the disc.

    Next you 'copy' the letter from DVLA and screen grab you have taken of the advert and take it to the seller demanding the amount in cash.

    If you get no joy, you can then issue a letter of demand and follow up with court action if he still does not reimburse you.

    The court fee is only around £35 which you will claim back, so the ball is in your court.

    Cowboy builders or tradesmen
    Car clockers
    Counterfeiters
    Aggressive selling

    Thats good advice from conniff regarding the tax disc, not owning a motor vehicle it did not occur that your girlfriend could lose her car clearly she can!.

    Thanks for the advice - bit of an update....

    She called the dealer this morning and they asked her to fax over a copy of the letter so they could try and contact the DVLA to pay for it again.

    They also told here they would call back within 2 hours to update them, they did not call back.... she then tried calling several times this afternoon and each time was told by a receptionist that everyone was busy with customers....

    I find this hard to believe as I'm fairly sure a Thursday afternoon is unlikely to see a rush of customers!!.

    I can already see this turning into a constant battle to try and talk to someone so would we be best off not messing about and going straight in with a demand letter?

    Is the 14 days a legal amount of time that needs to given or is this accepted as an amount of time that a court would accept as reasonable notice / time to resolve the issue?.

    No, you can set any time you want, make it seven if you would rather. I just think 14 gives him time to get sorted.

    I wonder if your girlfriend is aware of the the risks involved should she use the car untaxed as it could be confiscated.

    This has now been resolved - the dealer concerned has now made a 2nd payment for the Tax and we have confirmation that it has now cleared.
