Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
As you probably already know, I have an ongoing battle with these morons and have logged a complaint with the FSA after them giving me a partial refund of my PPI. After speaking to the FSA, they have such a huge backlog, and now I just want to get back my money and take them to court now. Can I do this as I have logged a complaint with the FSA ? if so, what is the first step to take ?
I really need all the help and support here if poss, this site is sooo great and helpful, and I hope fellow caggers can help me beat this vermin.

Are you sure it is the FSA and not the fos you have lodged your complaint with?
The Financial Ombudsman Service are the organisation that adjudicate on PPI mis-selling issues, can you confirm please?

Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc
Please do not PM me for advice as it may be sometime before I can respond.
Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
I would advise you to wait before starting down the court route especially as you have a complaint with the fos.
If you were to lose in court and you would need to be very well prepared to go to court. Then the FOS would probably not go against a court decision IMO.
My advice is FOS first (but this takes a long time) if your case is not upheld (90% of cases for mis-selling PPI are being upheld) you can then still go down the court route

Thanks for that......Im just so eager to get my money back and in excess of 15mths is a bit tooooo long haha
You can proceed to court if you are not happy to wait but you have to be prepared to face a legal team and if you are a Litigant In Person (LiP) then you can expect a serious fight in legal terms Best to make sure you have all the paperwork;-)
