I have registered under a new username as my other one could've given away my identity.
I have an Egg loan that is not in arrears (taken out in 2004). I have sent off a request for CCA (by special delivery and including £1 P.O.) this was received on 31/03/09. Since it is now day 13 shall i cancel my direct debit as a payment is due on the 28th?
Also do i send them a letter explaining why i have done this or just wait for another 30 days to be up?
If so has anyone got a link to the best letter to send.
Sorry for all the questions, i have read loads and loads on here but not seen anything which relates exactly to my case.
I have not heard anything from Egg yet and it is day 15 so i am going to send them an 'account in dispute' letter.
Also i am not going to offer any payment on the 28th and see what they do next.
One question i have is say it went all the way to court and it was enforceable, would i have to make up all the payments i had missed or simply just continue them, thus extending the lenght of the loan?
Letter sent today by recorded delivery so they will get it on Monday, i shall cancel my direct debit on that day too.
Fingers crossed they don't find my CCA, or if they do, it's unenforcable!
I have now received a 'contact us in 48 hours' or fear the wrath letter. they said i haven't replied to any previous correspondance, but i haven't had any. Does anyone think that my loan is unenforcable due to missing the 'total charge for credit' part or is it not worth pursuing?
It doesn't list the total chrage for credit, is that enough?
Also i heard that this requirement was introduced in may 2005, is that correct so have i not got a leg to stand on?
Hi..That seems to be different from most, most have the phrase 'Limit', and there are plenty of posts arguing its unenforceable as it should provide you with the Credit Limit or Amount Of Credit.
Looks like yours would be unenforceable due to missing any sort of credit limit.
