Had a HSBC Business a/c which was closed Feb 2008 when I was declared BR with a £10k o/d limit. It was always near the limit, can I claim charges back? If so is it worth it as the Bank was main my creditor - would they get the benefit from it!

If they are business charges, then frankly it seems unlikely that you can claim them as it looks as if the penalties argument for business charges may have failed and the Consumer regs argument couldn't apply.
You would have to declare it all to your creditors anyway.
Having said that, the question of whether business charges are penalties has only been decided in the High Court.
Someone with some stmina and some money could still take the issue to the court of appeal.
On the basis of of the CA judgment in the test case, there seems to be a chance of showoing that business charges are penalties.
