I'm so glad I found this site, all the other threads I have read make this journey I am about to take seem rather scarey.
Ah well, tomorrow I will be sending the first letter off to ask for all my statements (or all the charges), so in 40 days I should be posting back on here.
Got my microfiche letter today, Pam Speed also mentions not being able to give me the 'manual interventions' info., is this correct. Ah well, at least I have a ref. number now.

Go for the lot! The £12 was only a suggestion from the Ombudsman and as yet the banks have failed to acknowledge it as a fair charge. A couple of banks have now reduced their charges to £12 but are not applying it retrospectively.
1st Abbey claim settled 11th August - £5248.79
2nd Abbey claim started 21st September 2006

I thnk the 12 is in fact irrelevant, the OFt suggested this was the point that they would intervene automatically and did not necessarily reflect a legal charge.
Im not certain what would be lawful, but i suspect that the chagrges will not stay at 12 for long since pressure will continue to mount on the banks to show how they arrive at this figure.
since they have been unwilling so far to entertain any discussions about how they arrive at their charges then i think its got a way to go before anyone finalises what is actually legal and fair.

One quick question, I have written a list of all charges and dates of charges, and also included the wording from the statements, do i include this in my prelim lletter or keep it for the lba letter?

No thats fine - statements are supposed to be a seperate issue than your refund claim. Pam is based at the microfiche dept (as far as I know) and Anthony is the customer banking services manager so you've done it completely right.
Got a letter back today from Abbey complaints dept. signed by Mark Winder.
I am going to send the lba letter today, but need to know wether I should edit out the first line of the letter saying I haven't received any correspondance from Abbey, or wether this means I didnt get a satisfactory response from them.
Any ideas please would be great.

I've just sent my lba this morning, and I queried the first line, and in the end just put "satisfactorily" in after "respond". I think that was the best way of putting it, its on its way now, anyway!!!!
"We are very disappointed that you have failed to respond satisfactorily to our letter of the ......."
Just put the date in of which you sent your prelim letter.
Ok another question, in the lba letter it mentions the interest figure, how do I calculate it? Do I use the spreadsheet or do I just work out 8% of the total I want.

I'm not sure, but I think it is refering to interest that has been charged to your account due to these unlawful charges. The 8% interest on your charges does'nt come into play till you take them to court!
When preparing my claim, I thought it was getting too complicated & confusing to work out, ie. what part of the overdrawn interest was their entitlement and which part was mine due to their unlawful charges. So I did'nt bother with any of that, and am more than happy just to reclaim all the unlawful charges that they have taken from my account over the years!!!
great news everyone, before i contacted the courts, Abbey have sent back 813 quid into my account. i dont know wether this is because they have so many claims now and have caved in?
anyone else had this good fortune, i will transcribe the letter soon.
