    Default Cap1 PPI/FOS

    Some years ago Hfs Loans brokered a secured loan for me with a £7000 PPIicon. I am certain that this was missold and last year complained to Cap1 who had taken over Hfs. I got nowhere with them - they had no records but because I had signed an agreement which said I had received details of the policy they claim the ppi was not missold. I had not in fact received any details despite my signing. The complaint is with fosicon and nearly to the top of the pile. Recently Cap1 have been back in touch for the first time and would like details of the cost of ppi and interesticon paid from the lender. Where should I go from here? Should I request anything? Please advise!

    When you say they have been in touch was this by letter? if so send a copy to the FOS. If the contact was by phone I would write back asking them to put into writing exactly what information they require you to provide. Once you have the detail in writing you can then respond giving them the basic information and send their letter and your response to the FOS tagged with you complaint reference number.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    Thanks for that. The contact was by phone; they need me to provide an authority for the loan company (LMC) to disclose the information to Cap1. Apparently they are sending me this authority to sign (including a prepaid envelope) but it has not arrived yet. I'd value advice on this. Are they looking to settle,do you think? Am I scuppering my chances with fosicon? I reckon I am owed £7000 for the PPI and around £5000 interesticon before thinking of any extra interest at 8%. help!

    Whatever course you decide to go for always keep the FOS fully updated with any further correspondence both ways since the complaint was lodged.

    At the end of the day only you can make the call on what to do all caggers can do is offer some help and advice but not make your decisions for you.

    I am not new to this site and still not very expert

    The FOS may well have contacted them and so you get some response after several months. If this is the case then it seems like FOS maybe getting some results for you. Let us hope this is going to move things forward for you
