I took out a credit card in branch with Lloyds back in 2001. I realised a few months ago PPI was on my statements, so sent off a letter asking for it back.
Anyway yesterday I recieved a basic bog off letter, which states a few things I do not agree with:
We can confirm that you selected to have Payment Protection Cover on your original application form which you have signed doesnt it need to be on an actual agreement not an application? also I never ticked any boxes or anything, just signed the form. Could they have added it after? If so where do I stand?
Lloyds was required to ensure as far as possible it was suitable, explain provisions etc etc... nobody ever explained anything like this to me when I was in the branch! PPI was never mentioned!
Having reviewed your details, I have found no evidence to show you were ineligible or unsuitable for you based on your circumstances. Erm.. I think you only knew that I worked so I dont really class this as checking elibilty!
What is my next step here then? Would I be right in asking for a CCA? Plus there is the issue of them saying I selected it on my application, am I right in saying it should be an actual agreement? And also I didnt select it, the advisor must have after I signed it.
Any help would be greatly appreciated as to be honest I have had enough of these money grabbing gremlins

Well I have drafted a letter for SAR and CCA and will send it on Monday. Lets see what that brings up then. I cant see them having an application form from 8 yrs ago, but you never know! Also requested they provide their evidence I personally selected PPI, and the evidence they said they had that I was eligible for it. 12+2 days for CCA and 40 days for SAR, are these working days or calendar days?

SAR was a good first start, and they are calendar days, we do not want to give them too much leeway do we.
Wait and see what turns up them check everything 100% to ensure you have CCA, T & Cs, Statements, and any other data in any other format be it paper, electronic, Microfische, CD, tapes or transcripts etc also include in this request the needs and wants/customer duty of care questionnaire which should be filled in by staff every time at the point of sale. Call it a benchmark, safety measure, training requirement or whatever.
failure to comply should result in a non compliance letter + formal complaints to the Information Commissioners Office + Financial Services Authority + British Bankers Association + Financial Ombudsman Service and even the Office of Fair Trading the more bad publicity these people get for the PPI rip offs the better

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.

PPI Claims ongoing with:

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
Quick update;
They signed for my letter requesting SAR and CCA on the 5th May.
So thats gives them till 21st may for CCA and 14th June for SAR. Lets see what they bring up
