Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have been following the site for the along time and finally( Much belated it seems arg) sent the Reclaim letters to our Natwest Branch to reclaim approx £3,000 of charges.
They did not respond until the second letter (used Business templates from 'This is Money' site) and then offered a partial settlement.
The company has decided to decline the offer and progress with the case anyway, so i have a few questions if you dont mind
1) Is MCOL still automatically 'staying' business claims?
2) Can I check the points of law I am using with anyone before I fill in the final MCOL or Paper court copy please?
I appreciate that we have to use common law vs consumer and that we could get stayed like everyone else and also that its a massive grey area in regards to how business charges are currently 'not being addressed'.
Welcome to the site Mike.
First of all I would strongly suggest that you do not use the online route-its almost a foregone conclusion that your case will be stayed.
The other points concern the restrictions of the 1000 words (Although I do know that additional wording can be sent by post)
What are the periods covered by your claim ?
I urge you to get the terms and conditions for your account if you dont already have them.
You say they offered partial settlement ?
Would this be from Cobbetts ? and what percentage settlement did they offer ?
