I'm actually posting on behalf of my father in law. For years we were on to him to spend his money and get himself a nice new car. Well a few weeks ago he visited a skoda dealer seen a VW fox that he liked, 2007 plate with just 11,000 miles on the clock. Had a test drive etc and decided to buy it. He paid cash £5000 and took it home. On getting it home and taking a closer look when cleaning it he noticed that there was paintwork on front panel that didin't quite match and this putty stuff painted and inserted into a joint. he took it back to them and asked what this was only to be told it had previuosly been in an accident and repaired when the previous owner had it. At no time was my father in law informed of this at the time. They said they would take the car in put to their body shop and get the paintwork fixed. Well he called yesterday to say he had the car back but that the paintwork was now ok but they must have had a heat source near it to dry it which has now warped the plastic trim. On phoning the body shop they have said that they can fix by sticking it back in position. Surely this isn't sufficient. I have told him to take the car back and tell them he wants to reject it under the SOGA. These people have been devious and underhand by not mentioning the previous accident damage and repair before the sale, this incompetent attempt to fix one problem has now left him with another. What I want to know is can he reject the car and demand a full refund of his money. Sorry for it being a bit long.
I dont think you can reject it ubder SOGA unless it has been misdescrbed or unroadworthy etc. Best dealt with by negotiation until satisfied. Unless you think there is more wrong with the car, damage not repaired correctly etc. Get it checked it out by an engineer or another garage.
