Hi all I'm new to the forum but am looking for some advice for my mum, she has worked with a company for 9 and half yrs when they changed hands, her contract remained the same.
Two days after working for this new company she fell at home breaking her hip very badly, she was taken in to hospital and needed emergency surgery to repair it, since then she has been unable to work.
Initially speaking to her new area manager she was lovely, so genuine and concerned. She began sending sick notes in and on the day she was due to be paid there was no wages, she was devastated, I contacted her supervisor who stated that they didnt pay sick pay it was the social who would pay and they would send a cheque but they were never in a rush to help part timers and it would only be about £40 a week.
After ringing the inland revenue and stating all mums information, they confirmed that her works should pay, she earned enough. I got back on to them and she said to help mum out they would pay her the four weeks holiday she had left so that she would definately have some pay.
At the end of the four weeks her money stopped again, I phoned again and they said it was because my mum had never sent in any sick notes, she had they were always in and on time!
After telling them she was seeing a solicitor they suddenly found a sick note in the cleaning cupboard but the others had apparently been lost. Unable to pay for more sick notes she lost money.
Eventually they began paying her £62 per week, this continued for a while until they stopped her saying she was recieiving sick pay from the previous company, she wasnt!!! She proved this and they began paying her again.
At the end of March it was her 28th week so obviously ended, a couple of week later when we realised work had stopped paying we contacted employment and support and proceeeded with the forms to claim for some help, the inland revenue told her she would need her sick note back from her employer to claim this.
We then found out that really her employer should have informed her that her money would stop and sent an SSP 1 form by about the 23rd week of sickness.
I contacted her area manager and three messages later she still hadnt returned my call so I phoned head office who stated that they needed to get in touch with the people in payroll but they are over in Dublin so they would have to email them to ask about her sick note.
Her area manager then text me to say that they didnt return sick notes, her head office were supposed to contact my mum this morning with information but as of yet havent and we are just wondering were we stand, are they able to return sick notes?
This company have just been so unfair from start to finish, my poor mum even has been in court for eviction with all this messing about of her money and falling behind with bills, thankfully she was given chance but told she cant miss one more weeks rent and now has no income so is very concerned.
