    Can a Garage charge me for incompetent work?

    Hi
    My wifes car developed an engine management fault and she took it to a garage that we have been using for years. They had it a couple of weeks before admitting they didn`t know what was up and sent it to a specialist to have the head pressure tested.

    Long story short, when the engine came back to the garage, they hadn`t put it back together properly and the engine got destroyed as a result. Now the garage and specialists have agreed between them to pay for the replacement engine by a main dealer so thats all fine, however, the original garage is now asking for payment for the work they did before they blew the engine up!!!

    I know there is a clause under Sale of Services and Goods act which covers competent and timeley repairs, but where do i stand legally in regards to refusing to pay this bill. Bearing in mind that all the work they did was negated by the fact that a new engine wass required!!

    Any advice much appreciated!

    No they can't unless they can show that they caused some improvement in the situation.

    I suggest that you write them a careful letter setting out exactly what has happened and what your position is.
    If they are an official garage for the make then you shojld also send a letter to the customer relations of the car company.

    You should inform the garage that the sum they are seeking is in dispute and that you are happy to discuss it in court
