    Default How do I speed up purchase of car that has private plate?

    Hi,

    I've just struck a deal to purchase a car from a private seller.

    The car in question has a private plate (S666 CAGicon), which the seller wishes to retain.

    He has set in motion a process for retaining the registration for himself with DVLA, and is currently waiting, I assume, for the following (coloured text taken [and slightly changed to make sense] from the DVLA website):

    a confirmation letter to advise the replacement registration number
    a new tax disc showing the replacement registration number
    an authorisation letter (V948) to get your number plates made up

    According to the information on the website DVLA, Swansea will then send him:

    a retention document showing him as the grantee
    a registration certificate showing the replacement registration number

    These should arrive within four weeks of getting the confirmation letter. It can take up to six weeks if you use a V62 application to support your application.

    It's the last sentence, in blue, that concerns me. Obviously I would like to take ownership of the car as soon as possible.

    Do I have to wait up to four weeks for the registration document to come through before I can fill this document in with my details in order to take ownership of the car?

    The seller wants his money and I want my car, Is there a faster way of sorting this?

    This may be of use or not...but here goes
    If you want to assign a registration , its either a month via post and risking your documents with the black hole that is the DVLA or one day at a local office.
    To take plates off a vehicle it is a months wait, no dice on this as they have to check the old reg and assign a new one.
    I may be corrected, but thats how I've been dealt with in the past.

    Remember the Registered Keeper is not necessarily the legal Owner of a vehicle.

    If the V5C is currently in order and you are happy of the current owner's identity etc, then I see no reason why you couldn't proceed with the purchase and write into the agreement/receipt that you agree to release the registration number back to him on completion of the retention process, provided that he also pays for a supplies the new plates to go on your car.

    According to the DVLA website the following documents should come through within 7 working days:

    1. a confirmation letter to advise the replacement registration number
    2. a new tax disc showing the replacement registration number
    3. an authorisation letter (V94 to get your number plates made up

    What I don't understand is if DVLA have issued a confirmation letter to advise the replacement registration number why can't they issue a new registration document at the same time, because it seems that until the seller has that, he cannot transfer the ownership of the vehicle to me.

    I would be happy to do that, but from the current owners perspective, I don't how he would feel about me driving about in a car that would, for the short term, be registered in his name.

    As I said though, "registered in his name" does not mean "owned by him".

    You can but discuss it with him. From a legal point of view I don't think there is any problem. The receipt for the sale would show the time/day you became the owner (and in the eyes of the law the "keeper") so in terms of speeding/parking fines he would be able to state you were the keeper of the car at the time of the offence. Note "keeper" can also be a different person to the "registered keeper".

    You should also be aware the the V317 - used for transfer of a cherished number specifically states that the vehicle should not be sold or disposed of until the transfer is complete. (ie the seller has the V5C with the 'new' VRM). This tends to be 'honoured in the breach' though.

    When I have previously traded my car in, the dealer is well aware that the correct VRM, V5C and MoT certificate will follow as soon as I get them. He does however get to make a copy of the originals.

    As for you driving around in a car that is still registered to him.

    1) for speeding, etc. (s.172) he can nominate you as the keeper or driver;

    2) for decriminalised parking, he can prove that he is not the owner and thus the charge will fall to you. The TMA 2004 only assumes the RK to be the owner unless the contrary is proved.

    As stated above, it is all a matter of trust as this stage. If either feels that he cannot trust the other, then you just wait out the DVLA process.

    I've just done it, it'll be quicker if the current keeper retains/transfers the existing number & have a new number assigned to the vehicle you want to buy.

    If it's handed in to the local DVLA office it will be done within 7 days and the new V5 registration document issued witin two weeks.

    As I said I've done it twice within the past 12 months and in both cases the time taken was the same.

    My local office was Exeter & the transfers were done by the Truro office.
