Your help on this matter would be gratefully appreciated, my wife and I took out a HP agreement with First Response finance on the 31st March 09, and we both signed the agreement. I picked the car up on the 3rd April 09. I had just started up a new business, the dealer had said to put down my last employer as I had only left 2 weeks prior. Everything was ok then last Monday 6th April I had a collection agent come from First Response saying that they wanted the car back as the finance was taken under fraudulent terms. The car was on my drive at the time and after talking to the finance company they were not going to move on this, I handed the phone back to the collection agent and he said to me that all they wanted to do was get the car back and cancel the agreement.
I then phoned the finance company back after they had taken the car from my drive and explained the situation but they did not want to know, I emailed them and then someone rang me back later that day saying sorry but they were also going to keep to their agreement and still take the money from my bank every month, I ask for the car to be returned but they said no as it was a fraudulent claim for finance and I would have to keep paying, so now I have no car but still paying for finance on it. I also asked for the finance to stop under the 14 day changing of mind but they have said that because I signed the agreement on trade grounds it does not stand...
Please can someone help, my business has nearly failed already and my wife and I are in total stress, and about to lose everything we have worked for. thanks in advance. x

They said that they would only cancel GAP and Warrenty, the thing is that i need the car to do my job, i just need it back, i even said that i would pay in advance, my other car was a deposit so i have lost that as well.
I would invoke their complaints process and then go to the Financial Ombudsman. All sounds a bit weird to me. And I'm not sure whether they can take possession of your car off your drive without a court order.
