Hi i've just come across this site and would really like some help and advice please.
My partner got a car on HP in April 2006 through BH. He has been making regular payments up until mid 2008 when he had to change jobs for less pay and we had our seconed child. As you can imagine we came into financial difficalty at this time and things are only just working them selfs out.
My partner had made a few late payments but always tryed to pay what was owed.
At this point he owes: £4611.07 Opening Balance was: £12655.60 Car Price: £8200.00.
Things at the moment are very hard for us as we are trying very hard to get everything back on track.
What we want to know is, can we claim back all charges?? And seconedly if things took a turn for the worst and my partner was taken to court for non payment and the car taken can he claim back/get back what he has paid on the car so far? As what he is paying back now is the interest???
yes you can reclaim charges the stay is only applicable to banks not lenders like Black Horse so write to them recorded delivery asking for a refund of all charges.
have you got a copy of your agreement if so perhaps remove all personal details but uplaod it on here with figures and t&c's visable and then people can have a look and see if the agreement is worth the paper it is written on or not.

Park Motor Finance -----> incorrectly logged default on credit file claim for compensation
Lloyds Tsb ----> plenty of things all filed with Financial Ombudsman or Small Claims ----> settled by paying me full amount sought 02/05/09

Hi thanks for helping out. Please find a copy of the agreement below. What letter should we use for claiming back the charges and do we add the interest charges aswell?
I have loads of letters from BH with regards to so called late payments around £350 according to them.
My payments were been made by standing order on the last working day of each month but they came out with some garbage how they were not receiving the payments until after the cut off date on their system.
Just their way od trying to screw on honest customer paying on time out of more money. We will see about that though.
