Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I've just received a letter from A&L telling me that there is an issue with PPI on one of my unsecured loans. If I have an issue with it, then they will refund the payments and cancel the PPI.
My questions are.....
Due to the nature of my job I have never requested PPI on any loans that I've had in the last 18years. This makes me consider that it has been added without my consent. As such, is their admission of error also an admission that the credit agreement I have with them is also flawed and possibly an unenforceable agreement that they are trying to hold on to?
If so, do i start the ball rolling by acknowledging their letter and requesting a copy of the original credit agreement before agreeing to anything?
Also I seem to be having difficulty finding the template for starting the ball rolling with my other outstanding loans with no PPI issues (that i'm aware of), can anyone provide a link?
Also read the notes at the bottom as it explains how to go about this.
This step will or should i say should get you all the data they hold on you once you have this you will be in a better position to decide you next step.
Once you have the agreements it will be a good idea to post them on here removing personnel data first you can upload this to photobucket.com and use the eraser to remove personnel stuff.
Once uploaded and edited just post the links on here.
Then someone can take a look and give you guidance.
Would it not be quicker in this case if a do the request for a copy of my original credit agreement? If there's no mention of the PPI then it is surely an unenforceable loan?
the SAR u are using the data protection act to enforce the request u can go that route to get just the agreement but that will not in most cases make the process quicker better to be fully armed with all the info even more so if u want to go the unenforceabillity route u want them to show all there cards PF
