I have been given different advise from my local council tax office. When I rang them to enquire whether my mother who is a pensioner on pension credit and attendance allowance was entitled to a reduction in council tax. I explained that she lives with me and my husband we own the property but as her contribution she pays the council tax bill. It is in her name. I was told yes she would be entitled. I completed the forms on behalf of my mother and the response was that she is not entitiled to a reduction as we own the property and live there. What is correct please.
Your mother has no Council Tax liability on the property so she cant claim council tax benefit .
In Council Tax legislation a resident owner is always liable for the council tax due on the property, Council Tax Benefit can only be paid to the person who is liable for the council tax.
If the Council Tax bill is currently in your mothers name then this is in-correct, the governing legislation makes it clear that the legal liability rests with the resident owner.
while she is not entitled to CTB if u care 4 her then u can claim a 25% carers discount whether u get CB or not is worth checking out as im sure her AA qualifies u
Apparantly I am not entitled to claim carers allowance either as I work full time. I really can't understand this. My mother needs help bathing and with a number of other things. I care for her when not working but apparantly they will only let you claim carers allowance if you are there all day. She doesn't need to bath when I am at work it can be at any time. Such a ridculous law really, as I am certain if we tried to get her help through social services they would say no because she lives with us. If we decided this was no longer possible it would cost the state a hell of a lot more than carers allowance per week.
