The vehicle was purchased by myself in September 2008. In November the vehicle was using water. As I travel many miles per year and work 7 x 12, it was not feasible at that time to look for a replacement vehicle, but to instead look for someone who could undertake an engine rebuild, as I would have access to another vehicle whilst the work was being done.
Having ask advise from the marques forum, it was suggested that I try a garage in my area that specialise in Mercedes. A call was made to enquiry if the garage owner knew of anyone that did engine rebuilds. The replay was ‘ yes, me’
After a lengthy discussion with the proprietor as to what was required of the vehicle, He convinced me that he was ‘the man for the job’.
The vehicle went into the garage at the beginning of December 08, and the total cost of the work undertaken was in excess of £2,000.
When the vehicle was picked up on the first occasion, it soon became apparent that there was something wrong. There were noises from the engine and the vehicle had an oil leak. The vehicle was returned to the garage and left for a period of 5 days for the faults to be corrected. The vehicle went back again on several occasions for the faults to be rectified.
In March 2009 the vehicle went on a motorway journey, and as a result ended up on the hard shoulder with smoke coming from back. The vehicle was returned to the garage, where the proprietor advised that he would replace the bottom end.
Since the meeting I have had an Independent engineers report done on the vehicle which confirms that major repairs need to be undertaken and that the state of the engine is not comparable to the work that is supposed to have been carried out. The Engineer also suggested that the vehicle not be driven, as major problems could result.
Each time the vehicle has been returned from this garage, it has been in a worse state than when it went. Consequently, I have no confidence left in the ability of this mechanic, and in particular when he has admitted he must have done something wrong. I have managed to get his liability insurance details from him, and I am now considering putting in a claim against his insurance to recover my full cost.
Any advice on the legal aspects of the situation, and how best to lodge this claim would be greatly appreciated
