Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have a small claims action going through with a car dealer. I got a judgement in default, but as it appears the court did not get the dealers defence, they are applying for it to be set aside. I have a date in court- but what does this all mean?
If I lose the case overall- can the dealer come after me for anything? Grateful for any help
I had the same thing in Jan this year - got a judgement in default and they applied to have it put aside saying they had not got papers.
Anyway I turn up and so do they (how dare they) and we go into a court basically I didn't have to say anything they got a grilling from the judge about why he should believe them that they didn't get the papers etc - in the end the judge said he thought it fairer on all parties that he put it aside and let it go to court fully so neither party could have recourse
Anyway I'm back on 12th May and to be honest can't wait - convinced I'm gonna win.
Small claims I believe means little or no costs if you lose - sure someone will clarify this though
I am a layperson and have no legal training but I do have an iota of common sense (sometimes)
Welcome Finance PPI -----> over £3k court case filed SETTLED
Park Motor Finance -----> incorrectly logged default on credit file claim for compensation
Lloyds Tsb ----> plenty of things all filed with Financial Ombudsman or Small Claims ----> settled by paying me full amount sought 02/05/09
depends if the court believes them all not - your role will be fairly minimal as it's basically gonna come down to if the judge believes them or not. If they didn't send it signed for and have no proof that will be frowned on by the court
